    با پیشرفت فناوری های متعدد در عرصه تجارت بین الملل و فعالیت های اقتصادی، تحولات شگرفی پدید آمده است. مفاهیم سنتی حقوق مالیاتی مانند اصل منفعت و توانایی پرداخت و نیز مفاهیم سنتی اقتصادی مانند بی طرفی نسبت به صدور یا ورود سرمایه، پاسخگوی تحولات امروزی نیست. به ناچار نظام مالیات بین المللی می بایست خود را با تحولات تجاری وفق دهد. در این راستا دو رویکرد مدنظر علمای حقوق مالیات بین المللی است: رویکرد اول، استفاده از نظام واحد مالیاتی برای تمامی کشورها است ولی رویکرد دوم، با غیرعملی دانستن رویکرد اول، همکاری بین کشورها را در حال حاضر، چاره کار می داند.

    اگرچه در اسناد بین المللی حقوق بشری به طور صریح به حق دسترسی به داروهای اساسی و حیات بخش به عنوان «حقی بشری» اشاره نشده است، این حق، یکی از حقوق بنیادینی به شمار می رود که در نظام بین المللی حقوق بشر برای تحقق حق بر بهره مندی از سلامت جسمی و روانی مطلوب، ضرورت دارد. یکی از مهم ترین مسائل مرتبط با دسترسی به دارو، بحث حمایت بین المللی از ابداعات دارویی و تعارض احتمالی میان این نظام با نظام بین المللی حقوق بشر است. در موافقت نامه تریپس برای حل این تعارض، انعطاف هایی پیش بینی شده است که دولت ها می توانند با توسل به آن ها از بروز این تعارضات جلوگیری کنند. با تصویب اعلامیه دوحه و صدور تصمیم شورای تریپس درمورد اجرای مفاد بند 6 این اعلامیه، چارچوب جدیدی برای مجوزهای اجباری ایجاد شده است. محور اصلی این پژوهش این است که آیا وجود وضعیت های فوق العاده ملی می تواند عذری موجه برای دولت ها جهت عدول از رعایت مقررات بین المللی راجع به حمایت از ابداعات دارویی باشد یا خیر. موافقت نامه تریپس با پیش بینی امکان استفاده های دیگر از امتیازنامه های ثبت ابداعات دارویی بدون رضایت صاحب آن، به صورتی غیرمستقیم، راه را برای اعضای سازمان جهانی تجارت، جهت عدول از رعایت مقررات این موافقت نامه در موارد حادث شدن وضعیت بحرانی و اضطراری در حوزه بهداشت عمومی باز گذاشته است.

    شورای امنیت به عنوان مسئول اصلی و اولیه صلح و امنیت بین المللی و عالی ترین رکن سیاسی نظام بین المللی، از جایگاه رفیعی در جامعه بین المللی برخوردار است. درعین حال، این موقعیت والا و خصیصه سیاسی منجر به آن نمی شود که دادگاه های بین المللی نتوانند اقدامات این مرجع را از لحاظ قضایی بررسی کنند. دیوان دادگستری اروپا بر اساس رویه ای که از سال 2008 و از قضیه کادی شروع کرده، به طور مداوم و در قضایای متعددی، به بررسی قضایی اقدامات شورای امنیت پرداخته است (البته به طور غیرمستقیم و از مجرای بازبینی قضایی مصوبات تحریمی شورای اتحادیه اروپا که در راستای اجرای قطعنامه های تحریمی شورای امنیت به تصویب رسیده است). سایر دادگاه های بین المللی نیز در مواردی فرصت یافته اند تا در خصوص چالش امکان کنترل قضایی اقدامات شورای امنیت اظهارنظر کنند. دیوان بین المللی کیفری یوگسلاوی سابق در قضیه تادیچ، دیوان اروپایی حقوق بشر در قضیه بهرامی و سراماتی و قضیه نادا، دادگاه ویژه لبنان در قضیه عیاش و دیوان بین المللی کیفری رواندا در قضیه کانیاباشی که در اعمال وظیفه قضایی خویش با این مسئله مواجه بوده اند، رویه های متمایزی را در پیش گرفته اند. درعین حال، این امکان برای دیوان بین المللی کیفری نیز وجود دارد که قطعنامه های حاوی وضعیت ارجاعی از سوی شورای امنیت را مورد بررسی قضایی قرار دهد. اما دیوان بین المللی دادگستری با اینکه هیچ ممنوعیتی در این خصوص ندارد، در قضیه لاکربی، قضیه نامیبیا، قضیه هزینه های خاص و قضیه بوسنی وهرزگوین علیه صربستان و مونته نگرو که موقعیت برای بررسی مشروعیت (در معنای قانونی بودن)[1] تصمیمات شورا مهیا شده بود، با مصلحت اندیشی به این کار تن نداد. درکل به نظر می رسد که رویه ای بین المللی در خصوص امکان نظارت قضایی دادگاه های بین المللی بر شورای امنیت در حال شکل گیری است.

    تحریم کشتی رانی جمهوری اسلامی ایران (IRISL) که بخش عمده ای از آن شامل بازرسی محموله های کشتی ها به مقصد، یا از مبدا ایران، در مناطق مختلف دریایی و همچنین بلوکه کردن اموال سازمان های وابسته به کشتی رانی است، با تصویب قطعنامه 1929 شورای امنیت در سال 2010 ابعاد تازه تری یافت. به علاوه، شورای اتحادیه اروپا نیز طی تصمیمی در سال 2010 نام تعدادی دیگر از شرکت های وابسته به کشتی رانی جمهوری اسلامی ایران را به لیست تحریم های خود اضافه کرد. تحریم های چندجانبه و یک جانبه علیه ایران در زمینه کشتی رانی و دریانوردی، مغایر با برخی قواعد عام و خاص بین المللی ازجمله قواعد و مقررات حقوق بشری، معاهدات دوجانبه و چندجانبه مرتبط با موضوع و برخی قواعد موجود در عرف بین المللی است. بر این اساس می توان گفت بخش عمده ای از تحریم صنعت کشتی رانی ایران از سوی برخی کشورها غیرقانونی است که می تواند مسئولیت بین المللی آن دولت را به دنبال داشته باشد.

    قانون صلاحیت دادگستری جمهوری اسلامی ایران و همچنین استثنای تروریسم بر قانون مصونیت های حاکمیت خارجی ایالات متحده امریکا به دلیل ماهیت سیاسی خود، برای تنظیم روابط بین المللی از مفاهیمی استفاده می کنند که تاب تفاسیر متفاوتی داشته و می توانند با جهت گیری های سیاسی همراه شوند. این قوانین، هم در مرحله وضع و هم در اجرا، فاقد شفافیت، یکسانی در اجرا و قابلیت پیش بینی هستند. لذا این قوانین، قلب ماهیت شده و به جای ایجاد قاعده ای یکسان برای موارد مشابه، به ابزاری برای تسویه حساب های سیاسی تبدیل شده اند. این قوانین از خصائص یک قاعده حقوقی که ازجمله «کلی بودن، عمومی بودن و دائمی بودن» است، برخوردار نبوده و ابزاری هستند که به ترجیح از سایر ابزارهای تنظیم روابط بین دولت ها و خصوصا توسل به زور برای تنظیم روابط بین دولت های ذی ربط انتخاب شده اند. این قوانین، کلی نبوده و برای تنظیم روابط بین تمامی دولت ها وضع نشده و فقط به جهت تنظیم روابط بین دولت های بخصوصی وضع شده اند. این قوانین مقید بوده و به هنگام وضع، جهت شمول بر وضعیت دولت هایی که به عنوانی خاص توصیف می شوند (حامی تروریسم، ناقض مصونیت) وضع شده اند و فاقد عمومیت هستند. درنهایت بر وضع این قوانین، اراده ای دائمی وجود نداشته و تا زمان تلقی آن ها به این اوصاف یا نهایتا تا زمان عادی سازی روابط بین دولت ها باقی خواهند ماند و هدف از آن، ایجاد یک قاعده حقوقی برای موارد عادی بین دولت ها نیست. اما به هرحال در دوران عمر خود، آثار وضعی خود را بر حقوق بین الملل تحمیل خواهند کرد و ایجاد رویه ای خطرناک، حاصل از این قوانین، یکی از نگرانی های جامعه بین المللی در این امر است.
    دیوان بین المللی دادگستری در قضیه مصونیت های حاکمیت آلمان علیه ایتالیا نیز این برداشت را تایید کرده و این رویه را به عنوان عملی منفرد نامیده و به عنوا ن رویه بین المللی تثبیت شده تایید نمی کند. لذا بررسی این قوانین از منظر صرف حقوق یا دیپلماسی به تنهایی شاید نتایج دقیق و قابل اتکایی به وجود نیاورد. از همین رو، بررسی این قوانین از افقی بالاتر به گونه ای که جنبه هایی غیر از جنبه های حقوقی و قضایی آن را نیز شامل شود، احتمالا نتایج بهتری پدید خواهد آورد.

    در حوزه حقوق معاهدات، رضایت، یکی از اصول بنیادین است. ماده 36 کنوانسیون وین راجع به حقوق معاهدات با شرایطی سروکار دارد که به موجب آن، هر دولت می تواند به حقی به موجب معاهده ای استناد کند که وی عضو آن نیست. برقراری حق به نفع ثالث را باید در پرتو معیار اساسی رضایی بودن تعهدات قراردادی در نظام حقوق بین الملل مورد توجه قرار داد. در این صورت، این مسئله قابل طرح است که آیا حق دولت ثالث، ناشی از معاهده اصلی یا ناشی از قبولی حق توسط دولت ثالث و به عبارت دیگر، انعقاد معاهده فرعی میان ثالث و طرف های معاهده اصلی است. با توجه به نقش معاهدات در حقوق بین الملل، شناخت ابعاد حقوقی این نهاد در حوزه حقوق قراردادی و در چارچوب کنوانسیون وین، بسیار مهم است. در ارتباط با این موضوع اگرچه رویه قضایی اندک است، می توان رد پای آن را در برخی نظرات منضم به آرای دیوان دائمی و دیوان فعلی دادگستری بین المللی یافت. این تحقیق، ضمن بررسی ماهیت حقوقی تعهد به نفع ثالث، مواردی را که به ظاهر در این حوزه قرار می گیرد، اما واقعا مصداق ماده 36 کنوانسیون نیست تجزیه و تحلیل می کند.

    در کنار شورای امنیت و مجمع عمومی سازمان ملل متحد، دیوان بین المللی دادگستری از مهم ترین حافظان صلح، امنیت و همکاری بین دولت هاست. رجوع به دیوان، یکی از بهترین روش های حل و فصل اختلافات بوده و احکام آن برای دولت ها الزام آور است. ماده 94 منشور ملل متحد، به شورای امنیت اختیار داده است تا در صورت عدم اجرای حکم دیوان بین المللی دادگستری، اقدامات لازم را انجام دهد اما شورای امنیت در تاریخ فعالیت خود، حتی در مواردی که عدم اجرا روشن و واضح بود، هرگز از اختیارات ماده 94 استفاده نکرد. علی رغم فقدان نسبی سازوکار اجرای احکام، تبعیت از احکام دیوان، رضایت بخش بوده و این تصمیمات در غالب موارد اجرا شده است. این پژوهش در صدد است میزان اجرای احکام، عوامل موثر بر آن و نقش شورای امنیت به عنوان ضامن اجرای تصمیمات دیوان را بررسی کند.

    تفسیر و قضاوت راجع به دو مقوله «نگرانی های بین المللی» و «تعهدات بین المللی» مرتبط با برنامه هسته ای ایران، ازجمله امور اختلافی بوده که طرف های درگیر و ذی نفع، مواضع و دیدگاه های متعارض خاص خود را دارند. درحالی که مسئله اول، ماهیتا امری ذهنی است و احراز یا انکار آن، تابعی از متغیرهای غیرملموس عمدتا سیاسی امنیتی است، مسئله دوم اساسا مقوله ای عینی است که می توان با درنظرداشتن حقوق بین الملل قابل اعمال و حقایق اثبات شده، درمورد آن قضاوت کرد. همواره طرف های مقابل ایران با اشاره به «نگرانی های مشروع جامعه بین المللی»، پایبندی ایران به «تعهدات بین المللی» اش را خواستار شده اند. در مواضع ابرازشده، طرف های مقابل ایران بدون شکافتن مبانی استدلالی، به طور کلی ضمن تاکید بر مسئولیت های خود در تضمین اجرای تعهدات بین المللی ایران، بر ضرورت پایبندی به الزامات بین المللی اشاره می کنند. درمقابل، ایران ضمن اعلام آمادگی به منظور تعامل در جهت رفع نگرانی ها و اتخاذ داوطلبانه اقدامات اعتمادساز، همواره بر این عقیده بوده است که در عین التزام به «تکالیف بین المللی»، بر استیفای کامل «حقوق بین المللی خود، وفق معاهده عدم اشاعه هسته ای» مصر است. در میان مجموعه ای از ادعاهای حقوقی، این نوشتار تلاش دارد که تنها برخی اختلافات حقوقی عمده میان ایران و آژانس بین المللی انرژی اتمی به عنوان سازمان بین المللی تخصصی را از منظر حقوق بین الملل معاهدات بررسی کند. در مقاله، اختلافات حقوقی میان ایران و آژانس در زمینه مسئله احراز عدم پایبندی، گزارش دهی پرونده ایران به شورای امنیت، تعلیق اجرای ترتیبات فرعی و نهایتا، صلاحیت آژانس در رسیدگی به فعالیت های هسته ای غیراعلامی مورد قضاوت حقوقی بین المللی قرار خواهد گرفت.

    نانوفناوری نظامی، یکی از انواع حضور فناوری های نو در فضای مخاصمات مسلحانه تلقی می شود. اگرچه فلسفه اولیه توسعه نانوفناوری در صنایع نظامی برای استفاده در نبردهای شهری تنظیم شده بود، با تاثیر فزاینده آن بر تمامی جنبه های علوم و صنایع نظامی، اینک در تمامی انواع مخاصمات مسلحانه به کار می رود. بدون شک، این توسعه کاربرد نانوفناوری نظامی در سالیان گذشته، موجب تلفات عمده غیرنظامیان و اهداف غیر نظامی شده است به گونه ای که رعایت قواعد بین المللی بشردوستانه را اجتناب ناپذیر می کند. بااین حال، چالش ها و خلاهای عمده ای مطرح است مانند اینکه چگونه می توان اصول مسلم حقوق بین الملل بشردوستانه را با استفاده از نانوفناوری نظامی در صحنه مخاصماتی تطبیق داد؟ یا اینکه آیا هم اکنون قواعدی در حقوق بین الملل، برای محدود کردن کاربرد نانوفناوری نظامی وجود دارد؟ نتیجه تحقیق حاضر بدین صورت است که اگرچه اینک معاهده خاص بین المللی در زمینه کاربرد نانوفناوری نظامی در عرصه مخاصماتی وجود ندارد، از یک سو می توان با توسعه اصول حقوق بین الملل بشردوستانه، چون اصل عدم تفکیک میان رزمندگان و غیررزمندگان و اصول منع آسیب غیرضروری و منع آسیب به محیط زیست و از سوی دیگر، با اتکا به محدود سازی ارادی، کنترل پیشگیرانه و حقوق نرم به تنظیم کاربرد نانوفناوری نظامی در فضای مخاصماتی و به تبع آن، احترام بیشتر دولت ها به اصول حقوق بین الملل بشردوستانه در فضای مخاصماتی پرداخت.

    اصل حسن نیت به اشکال مختلف در قرارداد ایفای نقش می کند. شکل این ایفا در مرحله پیش قراردادی به صورت تحدید اصل آزادی مذاکره و منشا تعهدات تبعی چون دادن اطلاعات و رازداری است. در خصوص جایگاه حسن نیت در انعقاد قرارداد، بین نظام های مختلف حقوقی وحدت نظری وجود ندارد. این اختلاف در ماده 7 کنوانسیون بیع بین المللی کالا (1980) که مبهم و قابل تفسیر است ظاهر شد. این تحقیق در نظر دارد جایگاه حسن نیت را در انعقاد قرارداد با تاکید بر کنوانسیون بیع بین المللی کالا مطالعه کند. به طور کلی می توان گفت رویکرد منسجمی در خصوص اعمال حسن نیت در انعقاد قرارداد در کنوانسیون وجود ندارد و از این جهت، نظام حقوقی ایران با کنوانسیون وین هماهنگ است.

    Modern technologies brought about unbelievable evolution in international trade and business. Old legal principles including Benefit and Ability to pay and old concepts like Capital Import Neutrality (CIN) and Capital Export Neutrality (CON) are not anymore enough to answer the new problems arising from this evolution. International business taxation shall keep pace with this evolution. There are two approaches in this regard: an international taxation system or international tax cooperation. The first approach seems impractical. Hence, the second approach is the solution of the present problem of international business taxation.

    The right to access to essential and lifesaving drugs is considered as one of the most fundamental human rights which is necessary for the enjoyment of mental and physical health. However, this right has not been clearly defined in any international human rights document. With reference to international intellectual property law, one of the most important problems regarding this right is international protection for medical innovations. It is worth mentioning that a potential conflict may occur between international intellectual property law and international human rights law. TRIPS agreement has provided some flexibilities for adjustment and solving this potential conflict. In accordance with TRIPS agreement, states are obligated to enter into negotiations with patent holders for issuing licenses. Furthermore, in this article it is argued that in times of public emergency and other extreme emergency positions, such as epidemics, states are empowered to issue compulsory licenses without meeting the provided conditions in TRIPS agreement. Moreover, Doha Declaration and TRIPS Council Decision have established a new framework for issuing compulsory licenses.

    United Nations Security Council as the primary responsible organ for the maintenance of international peace and security and the superior political part of international order, has a prominent place in international community. However, this prominent position will not prevent International Courts to judicially control acts of this organ. Based on a precedent which has been started since 2008 and in Kadi Case, the European Court of Justice has frequently acted to judicially control Security Council acts in numerous instances. Moreover, other International Courts have declared their opinions on challenge of possibility of Judicial Control of Security Council acts. International Criminal Tribunal for the former Yugoslavia in Tadic Case, European Court of Human Rights in Behrami and Saramati Case and Nada Case, Special Tribunal for Lebanon in Ayyash Case, and International Criminal Tribunal for Rwanda in Kanyabashi Case, confronting this question in exercising of their jurisdiction, have adopted various approaches. However, this possibility has existed for International Criminal Court to judicially control the resolutions which contains referred position by the Security Council. While International Court of Justice has no limitation in this regard, in Lockerbie Case, Namibia Case, Certain Expenses Case, and Bosnia and Herzegovina v. Serbia and Montenegro Case which can control the legitimacy of Council acts, conveniently abstained and preferred to continue to pacific coexistence with Security Council, acting as two organs of an International organization. Thus, there is an emerging International practice related to possibility of Judicial Control of International Courts on Security Council.

    Sanctions on Iran shipping lines (IRISL), the major part of which consists of inspecting the ships’ cargo which their destination or departure is Iran in different marine zones, and also blocking the assets of the respective organizations found new dimensions after the adoption of the United Nations Security Council Resolution 1929. Furthermore, the European Union Council decided to designate some companies in its sanctions list, which are affiliated to IRISL multilateral and unilateral navigation sanctions against Iran. These acts are contrary to some special and general principles of international law including rules of human rights, respective bilateral and unilateral conventions and some customary rules. Accordingly, legality of the most of these sanctions can be challenged and it can give rise to the responsibility of relevant States.

    Owing to their diplomatic nature, both the Jurisdiction of Iranian Courts’ Act and the Terrorism Exception to Foreign Sovereign Immunities Act of the U.S.A use notions with different implications which may accompany with political orientations. The foregoing Acts lack transparency, uniformity and predictability in legislative and also in execution phases. Hence, the nature of these Acts have been transformed from a set of legal rules to phenomena which instead of creating a uniform principle for similar situations, build a tool dealing with political disparities. These Acts fail to meet traits of legal norms including “generality, commonness and permanency”. As a matter of fact, these Acts are alternative tools which have been chosen among others in lieu of the use of force by States. The aforementioned Acts have not been adopted to organize the relations among States and include only targeted States. These Acts are conditional and include only States defined as sponsors of terrorism. Finally, they are not permanent and exist only until the description of “sponsored terrorism” remains or, at last, until the relations among State become normal. It is evident that they have no intention to create a legal rule governing the normal situations. However, in their lifetime, they generate bad effects, malpractice and hazardous jurisprudence. The abovementioned consideration has somehow been confirmed in the case of Jurisdictional Immunities of the States, Germany v. Italy by the International Court of Justice (ICJ) recognizing the U.S.A Acts as not a settled practice. Hence, scrutinizing the Acts just from a legal or diplomatic prospect may not create reliable consequences. Therefore this survey studies them from an upper horizon which includes non-legal and judicial aspects.

    Consent is one of the fundamental principles in the realm of treaties. Article 36 of the Vienna Convention on the Law of Treaties deals with the conditions under which any State may be entitled to invoke a right under a treaty to which it is not a member. Providing right for the third State should be examined in the light of essential criterion of consent in conventional international law. Therefore this crux of the problem is whether the right of the third State is derived from the original treaty or from that States’ acceptance of the right or in other words, is the conclusion of a treaty among the third State and the original treaty parties. Given the crucial role of treaties in the international law, the understanding of legal dimensions of this entity is significant in the realm of conventional law and the Vienna Convention. In relation to this issue, although there are a few case laws, the trace could be seen in the annexed opinion of judges to PCIJ and ICJ decisions. This article analyzes the right for third law entities and explains items that are prima facie placed in this realm, but they are not actually instances of article 36 of the Vienna Convention.

    Together with the Security Council and the General Assembly, the International Court of Justice is one of the most important guarantors of peace, security and cooperation among states. The ICJ is a prominent mode of international dispute settlement and its judgments are binding upon states. Article 94(2) of the Charter of United Nations invests the Security Council with the power to give effect to a judgment of the ICJ, yet in its entire history, the Security Council has never employed its Article 94 powers even on occasions of clear non-compliance. Despite the relative lack of mechanism for the enforcement of judgments of the court, judgments have generally been complied with in practice. This study examines the degree of state compliance and the factors influencing it along with the role of the Security Council as the guarantor of the implementation of the decisions of the Court.

    Interpreting and adjudicating “international concerns” and “international obligations” in Iran’s nuclear program has always been among disputed issues between all engaged and interested parties with their own positions and contradictory views. While, the first issue is subjective in nature, the latter could be an objective one that can be defined and decided according to the applicable international law and the established facts. Some parties are referring to “international legitimate concerns of the international community” and also are demanding the Islamic Republic of Iran to abide by its so-called “international obligations”. They insist on their duties to ensure the implementation of international obligations by Iran and urging the compliance to international requirements. On the other side, the Islamic Republic of Iran while declaring its readiness to engage with such concerns believes that it can fully enjoy its rights according to the Nuclear Non-proliferation Treaty (NPT). Beside other legal claims, through the application of the rules and principles of the law of treaties, this paper deals with some major legal disputes raised between the Islamic Republic of Iran and the IAEA in terms of verification of non-compliance, reporting the Iranian case to the Security Council, suspending the implementation of subsidiary arrangements and finally exercising IAEA’s competence with respect to the non-declared activities.

    Military Nanotechnology is defined as one of the new technologies present in armed conflict areas. Although the basic philosophy of nanotechnology development in military industries was set up for urban combat, gradually its cumulative effect on all aspects of military science and industries has enabled us to understand military nanotechnology in all types of armed conflicts. No doubt, the development of military nanotechnology in the past years has led to major casualties to civilians and civilian targets that the observance of international humanitarian law seems inevitable. However, there are major challenges and gaps such as how to adjust certain principles of international humanitarian law with military nanotechnology in armed conflicts or whether there are relevant rules in international law for limiting the use of military nanotechnology. The conclusion of the current study shows that although there isn’t any certain international convention in the field of military nanotechnology in armed conflict situations, but at the one hand, it is possible to develop principles of international humanitarian law such as the principle of distinction between combatant and non-combatant, the principle of causing serious damage to the natural environment, principle on unnecessary suffering and on the other hand, by relying on voluntary limitation, proactive control and soft law, we can regulate the military nanotechnology in armed conflict situations and consequently we can see a greater respect of international humanitarian law among States.

    Principle of good faith plays its role in various forms in conclusion of a contract. Some aspects of this role is played in pre-contractual stage in the form of imposing limitations on principle of freedom of negotiation and also being as a basis for secondary obligations such as duty to disclose information and the duty of confidentiality. There is no agreement among legal systems concerning the status of good faith in contract-making. Disagreement particulary appears in interpreting the ambiguous text of article 7 of the United Nations Convention for the International Sale of Goods (CISG). This research aims to study and analyze the status of good faith in contract formation in the context of CISG. In an ultimate conclusion, it can be said that there is no coherent approach concerning the application of good faith in contract formation in context of CISG. As a result, it can be argued that there is a conformity between Iranian law and CISG.
