    به کارگیری روش مشارکت عمومی- خصوصی در بسیاری از کشورها متداول بوده و در این جهت قوانینی تصویب شده است. در ایران نیز برای اولین بار به روش مشارکت عمومی- خصوصی در بند (ب) ماده 214 قانون برنامه پنجم توسعه تصریح شده، ولی جزئیات آن بیان نشده است. ضوابط تفصیلی تری درباره مشارکت عمومی- خصوصی در قوانین بودجه سال های 1391 و 1392 درج شد، ولی به دلیل دائمی بودن این نوع مقررات، شورای نگهبان با تکرار این ضوابط در بودجه سال 1393 مخالفت کرد. بنابراین، در حال حاضر کشور ضوابط تفصیلی درباره مشارکت عمومی-خصوصی ندارد. در این مقاله ضمن تجزیه و تحلیل قوانین کشور از جمله مقررات مندرج در قوانین بودجه سال های گذشته، در پی آنیم که روش مشارکت عمومی- خصوصی در قوانین کشورمان با چه الگوها و در چه حوزه هایی تحقق می یابد و این الگو ها تا چه حد با تقسیم بندی های بین المللی مشارکت عمومی- خصوصی انطباق دارد.

    تسبیب در حقوق یکی از موجبات ضمان است که در حقوق مدنی، جبران خسارت و در حقوق کیفری، مجازات را در پی دارد. از آنجا که درباره تسبیب به طور جداگانه هم در حقوق مدنی و هم در حقوق کیفری بحث می شود این شائبه ایجاد شده است که تسبیب در حقوق مدنی متمایز با تسبیب در حقوق کیفری است، اما با مطالعه مبانی و شروط تسبیب این نکته به خوبی واضح می شود که ماهیت آن ها یکی است و نباید تفاوتی میان این دو در نظر گرفت. با اثبات یگانگی تسبیب در حقوق مدنی و کیفری می توان نتیجه گرفت که تفکیک تسبیب و ذکر آن به طور مستقل در دو قانون مدنی و کیفری، عبث و تکراری است و قابل دفاع نیست.

    یکی از مشخصه های دعاوی مالی در زمان تقدیم دادخواست، تکلیف خواهان به قید بهای خواسته در ستون خواسته است. بهای خواسته، نقش اصلی را در سرنوشت دعوا دارد، از جمله تعیین مرجع صالح برای رسیدگی و قابلیت رای دادگاه برای تجدیدنظر یا فرجام. اصولا، تعیین میزان بهای خواسته در اختیار خواهان است، ولی اعتراض به آن، لزوما در انحصار خوانده است. اعمال این اعتراض نیازمند فراهم کردن شرایطی است، از جمله باید تا اولین جلسه دادرسی مطرح شود، در مراحل بعدی رسیدگی موثر و ناظر بر اموال غیرپول باشد. حقوق دانان بر برخی از این شرایط اتفاق نظر دارند و درباره برخی از آن ها اختلاف نظر وجود دارد. در تالیف های حقوقی به همه شرایط اعتراض به بهای خواسته اشاره نشده است. از سوی دیگر، اگر این اعتراض موثر باشد، آثاری مهم در پی دارد. در این مقاله، با نگاهی انتقادی، شرایط اعتراض به بهای خواسته و نحوه رسیدگی دادگاه به آن، و در نهایت، آثار پذیرش اعتراض در دادرسی مدنی را بررسی و تحلیل می کند.

    بر اساس مقررات آیین دادرسی مدنی، داوران در رسیدگی و صدور حکم تابع مقررات آیین دادرسی نیستند، لیکن باید مقررات داوری را رعایت کنند. این ماده موجب اختلاف نظر زیادی بین حقوقدانان شده است تا جایی که عده ای از حقوقدانان معتقدند از آنجا که داوری نوعی قضاوت خصوصی است و تابع مقررات آیین دادرسی نیست، داور می تواند راسا یا به درخواست طرفین در جریان داوری، علاوه بر تشریفات قانونی، اصول مسلم دادرسی را نیز زیر پا گذارد و به آن توجه نکند. در تقابل با این عقیده، عده ای دیگر از حقوقدانان بیان می کنند از آنجا که اصول دادرسی دائمی، کلی، ارزشی و انتزاعی است، رعایت آن بر داوران و قضات دادگاه های دولتی الزامی است. به این دلیل داور حق ندارد به بهانه خصوصی بودن داوری از پایبندی و التزام به این اصول خودداری کند. در این مقاله سعی شده است به این مسئله پاسخ داده شود.

    در نظام حقوق بین الملل فرد در چارچوب قواعد اولیه صاحب حق بوده و دولت ها در برابر فرد تعهدات اولیه ای را به ویژه در زمینه حقوق بشر و حقوق بشردوستانه پذیرفته اند. در صورت نقض این تعهدات، بر اساس قواعد خاص معاهده ای و نیز قواعد عام مسئولیت بین المللی، از جمله قاعده عرفی جبران خسارت، تعهد به جبران خسارت دولت مسئول در برابر فرد نیز استقرار می یابد. آرای دیوان بین المللی دادگستری و طرح مسئولیت بین المللی دولت سال 2001 این حق جبران خسارت فرد را تایید کرده اند. با وجود این، دولت ها نسبت به پذیرش حق دادخواهی فرد نزد مراجع بین المللی اکراه دارند.

    از جمله مباحثی که امروزه اندیشه متفکران حقوق دادرسی را معطوف کرده است، رویکرد «قراردادی کردن دادگستری» است؛ این رویکرد با مخیرانه تفسیر کردن مقررات قانون آیین دادرسی مدنی، قائل به افزایش ابتکار عمل اصحاب دعوا، در این شعبه است. در این مقاله با توجه به این رویکرد، شروع دادرسی مدنی بررسی شده است. یکی از جلوه های مهم تاثیر اراده مشترک اصحاب دعوا در شروع دادرسی مدنی، تحدید حق دادخواهی است، با این توضیح که طرفین می توانند حق یکدیگر را برای طرح دعوا و شروع دادرسی محدود کنند. از موارد مهم دیگر تاثیر اراده مشترک اصحاب دعوا در شروع دادرسی مدنی، توافق طرفین بر دادگاه صالح است. همچنین، در ادامه، با طرح رهیافتی نو، درباره «شرط صلاحیت» سخن گفته شده است. طرفین ممکن است ضمن قرارداد اصلی خویش، توافق کنند اختلافات حاصل از قرارداد حاضر در دادگاهی غیر از دادگاه محل اقامت خوانده مطرح شود، یا در کارکردی دیگر از این شرط، از مجموع دادگاه هایی که به طور هم عرض صلاحیت رسیدگی به دعوا را دارند، به طور مشخص، دادگاهی برای رسیدگی به دعوا تعیین شود.
    از مصادیق دیگر تاثیرگذاری اراده مشترک اصحاب دعوا در شروع دادرسی مدنی، مبحث «ابلاغ» است، به این معنی که اصحاب دعوا می توانند درباره مکان ابلاغ، گیرنده ابلاغ و شیوه ابلاغ توافق کنند.

    از موضوعات بسیار مهمی که همواره به عنوان خلا در قانون آیین دادرسی مدنی مطرح بوده است، امکان صدور دستور موقت از جانب دیوان داوری است. در شرایط فعلی صدور دستور موقت هم از دادگاه و هم از دیوان داوری به سادگی ممکن نیست و مراجع داوری و دادگاه ها اگر نگوییم مطلقا، دست کم به طور غالب، از اجابت درخواست صدور دستور موقت، به دلیل خلا قانونی سر باز می زنند. صادرنکردن دستور موقت توسط دادگاه به دلیل تفسیر رایج آن ها از ماده 311 ق.آ.د.م است که رسیدگی به درخواست دستور موقت را در صلاحیت دادگاهی می داند که اصل دعوا در آنجا مطرح است و صادرنکردن دستور توسط دیوان های داوری، به دلیل حاکمیتی تلقی کردن آن و اعتقاد به نبود چنین اختیاری توسط مراجع خصوصی حل اختلاف در فرض عدم تصریح قانونگذار است. این اعتقاد در مواردی که موضوع از جانب طرفین نیز مسکوت گذارده شده باشد، بیشتر در دیوان های داوری تقویت می شود. حال آنکه صدور قرار دستور موقت از جمله مقتضیات و نیازمندی های رسیدگی به دعوی و اختلاف است که قانون برای پاسخگویی به این نیاز باید راه حلی مطرح کند. این مقاله به دنبال پاسخ به این پرسش است که در موارد فوری و ضروری که در جریان رسیدگی داوری پیش می آید، کدام مرجع باید نسبت به موضوع تعیین تکلیف کند، مرجع داوری یا دادگاه یا هر دو؟ در فرض اخیر آیا ترتبی وجود دارد یا صلاحیت و اختیار این مراجع هم زمان است؟ همچنین، اجرای دستور موقت صادره توسط مراجع داوری چگونه میسر است؟ سرانجام، خلا قانونی به ویژه در قانون آیین دادرسی مدنی چه تاثیری بر موضوع دارد و چگونه باید جبران شود؟

    The mechanism of public-private partnership (PPP) has been used in different countries. Many countries have enacted special laws to regulate PPPs. In Iran، PPP as such has been briefly mentioned in the Fifth Five Year Development Act and more details of PPPs were provided in the yearly budget acts of 1391 and 1392 (2012 and 2013). In the Budget Act of 1393 (2014) the detailed provisions regarding PPP have been eventually removed from that Act as being regarded by the Guardian Council of Constitution as having a permanent nature and could not be mentioned in a yearly budget act and therefore no detailed regulations regarding PPP are now effective. In this paper we review all laws and regulations so far enacted for PPP to see to what extent they could create a stable situation for the private sector to participate in state and public projects.

    The causation (Tasbib) is a ground of liability in law which leads to compensation of damages in civil law and punishment in criminal law. As causation being discussed in both civil law and criminal law separately، it is generally perceived that the causation in civil law is different from that of criminal law. By reviewing the roots and conditions of causation، it becomes clear that the nature of causation in both fields is the same and there are no significant differences between them. By perceiving the causation as a similar concept in both civil and criminal law، we could conclude that separating the causation and dealing with it differently in civil and criminal law is not fruitful and rewarding and therefore it should be disregarded.

    One of the characteristics of pecuniary claims at the time of submitting the lawsuit is obligation of the plaintiff to mention the value of relief sought. The amount of relief sought plays a key role in the lawsuit which determines the competent court، the possibility of appeals. Basically، the value of relief is determined by the plaintiff which may be protested by the defendant. This protest requires certain conditions to be accepted; for example، it has to be raised by end of first session of the proceedings. In legal writings، the details of conditions for reliefs sought are not mentioned. On the other hand، if an objection is accepted، it will have important effects on the litigation. In this paper، the conditions of objection to value of relief sought are critically examined and the effects of raising such objection in civil proceedings are discussed and analyzed.

    According to the provisions of Civil Proceedings Code، courts procedural principles and formalities are not required to be respected in arbitration. Such provisions are differently interpreted by lawyers. Some lawyers believe that since arbitration is a kind of personal judgment، it should not be subject to the civil procedure and therefore arbitrators directly or with the request of the parties may refrain from applying the courts procedural principles and formalities in conducting arbitration. In contrast، some other lawyers argue that since such principles and formalities are compulsory، permanent and general، therefore it is binding for both court judges and private arbitrators. In this paper، this issue will be considered and discussed.

    In the system of international law، individuals enjoy some rights and states are initially obliged to grant of these rights، especially in the field of human rights and humanitarian law. If this obligation is not fulfilled، the responsible state has to compensate the injured individuals based on special rules of treaty laws and general rules of international responsibility، including customary rules of compensation. The right to compensation has been confirmed by the International Court of Justice and the Draft Articles of Responsibility of States for Internationally Wrongful Acts 2001. However، states are reluctant to accept the individuals'' right to petition against the states before the international authorities.

    One of the topics that today has attracted attention of civil proceeding lawyers is a contractual approach to the commencement of litigation. In this approach، the litigants may by mutual agreement refer their case to a specific branch of court. In this paper، we discuss the commencement of civil proceedings by the agreement of litigants and how far it is possible for the parties to select the court. The parties to a dispute may wish to limit themselves to initiate court suits in any place requiring them to bring their case in a specific branch of court. Other important example of the common intention of the litigants is the issue of notifications.

    One of the most important issues which has long been considered as a shortfall in the Civil Procedure Code (CPC) is the jurisdiction of the arbitral tribunal to issue interim orders. Currently، neither the court nor the arbitral tribunal can freely grant the interim measure so that the tribunals and the court hardly accept the plea for granting the interim measure. The reason lies in the shortfalls of the law as the courts’ interpretation of Article 311 of CPC is that only the court receiving the case at the first place can grant such interim order as the issuance of interim orders requires specific authorization by the law. Such opinion is more emphasized when the parties to the dispute fail to clearly grant such authorization to the arbitrators. However، granting the right to arbitrators to issue interim orders is needed in for a sound arbitral proceedings. The present paper tries to clarify which authority has the jurisdiction to deal with urgent cases and issue interim orders in arbitral proceedings: the arbitral tribunal or the court or both? This paper also examines how it would be possible for arbitral tribunal to enforce an interim order. Finally، the consequences of the gap in the CPC on the issue of issuing interim orders by arbitral tribunal will be discussed.
