    امروزه با ظهور تفکر جهانی شدن و دولت های فراتنظیمی که موجب گسترش روابط اجتماعی و ارتباطات در سطح ملی و فراملی شده است، قدرتهای سیاسی، اقتصادی، فرهنگی و اجتماعی متعددی ظهور یافته اند که موجبات پدیداری نوعی حاکمیت متکثر را پدید آوردهاند. مبانی فکری و فلسفی این مهم، به خوبی در دستگاه فکری فوکو مشهود است. لذا با بررسی مفهوم حاکمیت در عرصه حاکمیت جهانی و دولتهای فراتنظیمی و تبیین ریشه فلسفی مفهوم پسامدرن حاکمیت در اندیشه فوکو، معلوم می شود که مفهوم حاکمیت، دچار تغییر و تحول مفهومی عمیقی شده است. لذا در این مقاله تلاش می شود تا این مفهوم نوین حاکمیت به خوبی واکاوی شود. شناخت چنین مفهوم نوینی از حاکمیت برای تعیین سیاستها و قوانین آتی جامعه، بسیار حائز اهمیت است. در این مقاله با رویکرد حقوق عمومی، مفهوم پسامدرن حاکمیت به تصویر کشیده میشود.

    یکی از مهمترین تحولات بین المللی معاصر در عرصه ثبت اختراع، توافق اخیر کشورهای عضو اتحادیه اروپا در تدوین و تقنین مقررات برای ایجاد نظام واحد ثبت اختراع است. بهموجب این توافق، بعد از اعطای گواهینامه ثبت توسط دفتر اروپایی، ثبت اختراع این گواهینامه بدون نیاز به اعتبارسازی در تکتک کشورها، در قلمرو اتحادیه قابلیت اجرایی خواهد داشت. این توافق همچنین متضمن ایجاد یک دادگاه واحد با صلاحیت رسیدگی به دعاوی مربوط به گواهینامه در سراسر قلمرو اتحادیه اروپاست. با توجه به اهمیت این توافق، تبیین تاثیرات حقوقی و اقتصادی آن بر سیاستهای صنایع و شرکتهای مختلف در زمینه های تحقیق، ابداع و تجاریسازی اختراعات، ضرورت پیدا میکند. مقاله حاضر، ضمن مطالعه اجزای این توافق، پیامدهای حقوقی استقرار نظام واحد ثبت اختراع در اروپا را تحلیل میکند.

    حقوق بشر سخن به میان می آید. شاید این نسبیت « نسبیت » امروزه بهسادگی از ناخواسته باشد، اما چنین رویکردی معلول نگاه وضعی به حقوق بشر است. حقوق بشر معاصر ازآنرو که مرزی سلیم و صحیح بین حقوق بشر با حقوق شهروندی نگذارده است، لاجرم در دام نسبیتی افتاده که مخالف هدف اولیه و جهانشمولی او بوده است. این نقض غرض که در وادی تفسیر اسناد بین المللی، راه را بر هر نوع نسبیتی باز میکند، مفروض نوشتار حاضر است. لذا فرضیه نگارنده این است که حقوق بشر به فرض نسبیت نمیتواند جهانشمول باشد. برای این منظور، نوشتار حاضر به تاسیس حقوقی جهانشمول مبتنی بر به رسمیت شناختن نوعی انسان شناسی از حقوق بشر میل میکند که در آن در هر عصر و شهری، طبیعت آدمی، بنیان و جوهر حقوق او تلقی میشود

    بانک ها نقشی اساسی و مهم در اقتصاد کشورها دارند. آن ها منابع مالی مشتریان را جذب و از طرق متعدد به صورت تسهیلات مالی در اختیار متقاضیان قرار می دهند. در این رابطه، بانک بر مبنای توانایی خود و اعتبارسنجی متقاضیان تسهیلات، رابطه مالی خود را تنظیم می کند. بااین حال، محدودیت در تامین منابع مالی توسط بانک و نیز پیچیدگی روابط بانکی و ریسک ذاتی ناشی از ارائه تسهیلات به متقاضیان باعث شده است که بانک ها مدلی برای تامین کافی منابع مالی و توزیع ریسک های خود طراحی کنند. یکی از این روش های تامین مالی، ارائه تسهیلات به صورت سندیکایی است که در آن بیش از یک بانک در ارائه تسهیلات نقش دارند. در این تحقیق، تلاش بر این است تا با یک مدل تحلیلی و توصیفی، مفهوم و ساختار تسهیلات سندیکایی و ضرورت وجود این نوع تسهیلات در سیستم اقتصادی و حقوقی ایران بررسی شود.این مقاله در پایان به این نتیجه می رسد که دلیل اصلی عدم استفاده از این تسهیلات در نظام بانکی ایران، نبود قوانین کافی در این حوزه و عدم تشریح ساختار قراردادی این نوع تسهیلات و قواعد حقوقی ناظر بر روابط بانک های عضو سندیکا است.

    از آغاز آفرینش و ایجاد اجتماعات بشری تا به امروز، خطرات بسیاری زندگی افراد را در معرض تهدید قرار داده است. برخی از این خطرات، چنان تاثیر اقتصادی به جا می گذارد و سطح معاش را به پایین ترین حد خود می کشاند که سبب می شود دولت ها در برابر قربانیان، احساس مسئولیت کرده و تلاش خود را در جهت مدیریت این خطرات، ساماندهی کنند. اعلام چنین مسئولیتی از سوی دولت ها و ایجاد بیمه های اجتماعی سبب می شود این گونه خطرها، رنگ اجتماعی به خود گیرد. اگرچه مصادیق خطرهای اجتماعی که می توان آن ها را در سه دسته خطرهای ناشی از زندگی حرفه ای، خطرهای جسمانی و خطرهای برآمده از تشکیل خانواده قرار داد، در بسیاری از نظام های حقوقی شناسایی شده اند اما مفهوم خطر اجتماعی همچنان مهجور مانده است.از این رو در پژوهش حاضر، سعی بر آن شده است با تکیه بر عناصر مشترک خطرات اجتماعی و آموزه های نظریه پردازان در حقوق فرانسه، به تعریفی منسجم از اصطلاح خطر اجتماعی دست یابیم.پس از شناخت مفهوم خطر اجتماعی و بررسی مصادیق آن در حقوق ایران، اشکالاتی جهت توزیع و اجتماعی ساختن این قسم از خطرات نمایان می شود که با یاری جستن از برخی دستاوردهای نظام تامین اجتماعی فرانسه می توان در جهت رفع این اشکالات برآمد.

    کاربردسلاح های شیمیایی به واسطه آسیب های گسترده ای که در قربانیان ایجاد کرده، در میان جنایات رژیم صدام حسین، جایگاه خاصی دارد. مقتضای عدالت آن است که این گونه جنایات خطیر مورد توجه جامعه بین المللی، بدون مجازات نمانند. برمبنای معاهدات و عرف بین المللی، تردیدی در خصوص ممنوعیت کاربرد تسلیحات شیمیایی در دهه 1980 وجود ندارد. نفس همین ممنوعیت(بدون نیاز به جرم انگاری صریح) می تواندمبنایی برای مسئولیت کیفری مرتکبین این اعمال باشد. ضمن یاد آوری رویه دادگاه نورنبرگ، مقاله حاضر،نشانداده که اگر دادگاه بین المللی صالحی برای رسیدگی به این جنایات وجود داشته باشد، مشکلی از حیث قانونی بودن جرم وجود نخواهدداشت؛ اما چون در حال حاضر، هیچ دادگاه بین المللی حائز صلاحیت و مرتبط با جنگ ایران و عراق وجود ندارد، موضوع اجرای حقوق بین الملل، می تواند مورد توجه دادگاه های داخلی قرار گیرد. مقاله حاضر، با این اعتقاد که دادگاه های ایران، علی القاعده دارای صلاحیت رسیدگی به این جنایات هستند، پیشنهاد کرده که برای ایفای نقش موثر دادگاه ها در حمایت از حقوق بین الملل و کاهش آلام قربانیان،اصلاحاتی در برخی قوانین جزایی صورت پذیرد.

    بر اساس نگرش غایت محورانه انسانی، آزادی بیان از مقتضیات استقلال فردی انسان به مثابه یک غایت بالذات است و محدودسازی آن را باید در چارچوب استثنای ضروری تبیین کرد. در ساحت حقوق طبیعی نیز آزادی، حق طبیعی است و ایجاد هرگونه محدودیتی در تغایر بالذات با این حق به شمار می آید. در عصر حاضر، بدون تردید، تلویزیون به عنوان یکی از نیرومندترین ابزارهای آزادی بیان، به خدمت گرفته می شود. اما درعین حال، استفاده نابه جا از این دستگاه می تواند باعث تعرض به حقوق عمومی و خصوصی شود. لذا ایجاد محدودیت برای فعالیت شبکه های تلویزیونی ضروری است. در همین راستا تمامی اسناد بین المللی حقوق بشر، محدودیت هایی را برای تلویزیون مقرر داشته اند. نظام حقوقی ایران نیز چنین محدودیت هایی را در نظر گرفته است که برخی از آن ، با محدودیت های مقرر در اسناد بین الملل حقوق بشر، قابل انطباق است و برخی دیگر، مانند موازین و ضوابط اسلامی در هیچ سند بین المللی به عنوان محدودیت آزادی بیان یافت نمی شود. علاوه بر این به نظر می رسد تفاسیر شورای نگهبان بر اصول 44 و 175 قانون اساسی، نوعی محدودیت اضافه بر ابزارهای آزادی بیان باشد. در نوشتار حاضر برآنیم که با بررسی تطبیقی اسناد یادشده، محدودیت های شکلی و ماهوی آزادی بیان در صدا وسیمای ایران مورد واکاوی قرار گیرد.

    With the advent of globalization and post-regulatory States that enhance social relations and communications at the national and international levels, various political, economic, social and cultural powers have been emerged resulting in the appearance of a pluralistic sovereignty. Intellectual and philosophical foundations of this matter is well evident in Foucault's thought. Therefore, with the study of sovereignty in the area of global governance and post-regulatory States, and explaining the philosophical roots of the post-modern concept of sovereignty in Foucault's thought, it is revealed that the concept of sovereignty is deeply changed in meaning; and so, this paper attempts to analyze this new concept of sovereignty. Moreover, the understanding of recent concept of sovereignty to determine future policies and laws of the society deems significant. Focusing on public law, the postmodern concept of sovereignty is portrayed in this paper.

    Undoubtedly, one of the most significant changes in the patent system is the recent EU Member States’ agreement on signing and approving the regulations concerning new unitary patent system. On the basis of this agreement, after the grant of patents by European Patent Office, there would be no need for patentees to validate their patents for which unitary effect has been requested in the territory of participating EU Member States. This agreement also includes the creation of Unified Patent Court with exclusive jurisdiction over unitary patents and European patents throughout member States. Due to the importance of this agreement, the identification and clarification of its legal and economic impacts on the policies of the industries and companies in regard to research, innovations and commercialization of patented inventions is deemed to be imperative. This Article tries to study the details of this agreement and analyses legal consequences of the establishment of the new patent system in Europe.

    Nowadays, it is very common to simply talk about the "relativity" of human rights. Perhaps this relativistic approach might be the unintended consequence of a situational looking at human rights. Since there is no common and correct boundary between the human rights and civil rights, it has inevitably fallen into the trap of relativism that had been opposed to its primary and universal objective. This boundary which paves the way for any relativistic interpretation of international instruments makes the assumption of the present article. Therefore, given the relativity of human rights, it may not be deemed universal. To this end, this paper goes on to establish a universal law based on the recognition of an anthropology of human rights in which in every age and every place, the essence of human nature is deemed.

    Banks play an important role as an intermediary in the financial system between the lenders and applicants of financial sources. They absorb the financial sources of customers and present them to applicants. Their financial relations are arranged on the basis of the credit rating of their applicants. The financing restrictions and complexity of banks relations and inherent risk of financing have made the banks to design a model to fund their financial sources and distribute their various risks. One of these models is financing by using syndicated loans. Since most of the big projects need a high amount of financial sources, the use and significance of syndicated loans is increasing. In this paper, we tried to examine the concept and structure of syndicated loans by using an analytical and descriptive model which explains the necessity of using this method in the legal and economic system of Iran. We concluded that the main reasons given for non-use of this method are the lack of adequate legislations in this field and the absence of information transparency in the contractual structure of such credits as well as the legal rules governing relations between syndicate members.

    Out of many heinous crimes done under Saddam Hussein, few had such disturbing and long-lasting human effects as the use of chemical weapons (CW). In order to serve the interests of justice, such serious crimes of international concern should not go unpunished. Based on the treaty and customary laws applicable in the 1980s, the use of chemical weapons was prohibited under international law. Such prohibition in itself (without explicit criminalization) could be a basis for criminal responsibility of the individuals involved. So, if there were competent international tribunals existing to address such crimes, the tribunals would have no problems in terms of legality. But currently, no international tribunals exist with any link to the Iraq-Iran war in the 1980s. The issue of enforcing international law by domestic courts is thus brought into attention. The article concludes that Iranian courts should have jurisdiction over such incidents. In order for the Iranian judicial forums to get involved in an effective manner, it is suggested that legislation is necessary to get into some coordination with international law.

    According to the extremity-centered attitude of human, freedom of expression is
    a requirement for the individual independence of human being as an essential
    end, so the restrictions on which should be determined within the framework of
    the essential exception. Freedom stands in the realm of the natural rights and
    restricting it in any manner is against that essential right. In the current age,
    television can undoubtedly be utilized as one of the most powerful media in the
    service of freedom of expression. However, at the same time, mal-use of this
    device can offend both public and private rights. Therefore, restricting the
    domain of activities for the TV channels is essential. In this regard, the
    international documents of human rights have set restrictions for TV. The
    Iranian legal system considers some restrictions for this matter too, some of
    which are compatible with those prescribed in the international documents of
    human rights and some others such as the Islamic rules and standards cannot be
    found in any other international documents as the restrictions on freedom of
    expression. It seems that the Guardian Council's interpretations of Articles 44
    and 175 of the constitution are a kind of additional constraint on the freedom of
    expression. In this paper, by conducting a comparative analysis on the said
    documents, we analyze the restricions on form and nature of the freedom of
    expression in the Islamic Republic of Iran’s Broadcasting Corporation
