    قانونگذار در قانون مجازات اسلامی مصوب 1392 طی ماده 282 مقرر کرده است: «حد محاربه یکی از چهار مجازات ذیل است: الف. اعدام؛ ب. صلب؛ پ. قطع دست راست و پای چپ؛ ت. نفی بلد». سپس در ماده 283 همان قانون، برپایه یکی از دو دیدگاه فقهی موجود در این زمینه (دیدگاه تخییر) اعلام کرده است: «انتخاب هریک از امور چهارگانه مذکور در ماده 282 به اختیار قاضی است». قاضی براساس ماده 283 اختیار مطلق دارد که هریک از مجازات های موجود در ماده 282 را در حق محارب انتخاب نماید. باوجود این، وضع ماده 283 مبنی بر تفویض اختیار مطلق انتخاب مجازات به قاضی علاوه بر اینکه صحیح ترین دیدگاه فقهی در این باره نیست، با نقدهای جدی مانند تعارض با فلسفه تشریع حدود الهی و رعایت نشدن اصل تناسب جرم با مجازات روبه روست؛ همچنین سبب جلوگیری از ایجاد وحدت رویه قضایی نیز می شود. در مقابل «دیدگاه تخییر»، دیدگاه فقهی دیگری با عنوان «دیدگاه ترتیب» موجود است که علاوه بر وجود شاخص اصل عدالت محوری در دیدگاه ترتیب، هیچ یک از نقدهای «دیدگاه تخییر» در آن وجود ندارد. پژوهش پیش رو، برپایه ارزیابی ادله به روش توصیفی تحلیلی، در نهایت، رعایت ترتیب در مجازات را امری لازم می داند و از این رهگذر ماده 283 را نقد می کند و پیشنهاد اصلاح آن را ارائه می دهد.

    ارتداد و مجازات آن از احکام بحث برانگیز اسلامی است. در فقه شیعه، ارتداد به دو نوع فطری و ملی تقسیم می شود. شدیدترین مجازات ارتداد مربوط به مرتد فطری مرد است که افزون بر مجازات قتل، احکام خاص دیگری را نیز درپی دارد. مشهور فقی هان شیعه در تعریف مرتد فطری دو شرط ذکر نموده اند: نخست، مسلمان بودن دست کم یکی از والدین در هنگام انعقاد نطفه؛ دوم، اختیار اسلام خود فرد در هنگام بلوغ. چند دلیل نقلی و غیرنقلی درباره شرط نخست بیان شده است. در این پژوهش با بررسی دقیق این دلایل روشن شده که هیچ کدام تام نیستند؛ بلکه ظاهر روایات و سخن فقی هان بیانگر لزوم اسلام والدین است. این نظر مقتضای اصل و قاعده درء و احتیاط نیز هست.

    قرن حاضر که به عصر ارتباطات و تعامل بیشتر میان فرهنگ های جهانی معروف شده، با نظریه ای به نام «جنگ تمدن ها» روبه رو شده است. در مقابل، اسلام بر سلم و دوستی و هم گرایی و تعامل سازنده فرهنگ ها و در کنار آن، دعوت دیگر فرهنگ ها به معارف خود تاکید کرده است. با توجه به اینکه راهبرد اسلامی در آغاز ارتباطات، «ارتباط سلام آغاز» است، پرسش این است که حکم فقهی سلام کردن بر غیرمسلمان چیست؟ مشهور فقی هان شیعه سلام کردن بر غیرمسلمانان را مکروه دانسته و برخی نیز معتقدند حرام است؛ برخی نیز آن را درصورت تاثیر مثبت در جذب غیرمسلمانان مجاز دانسته اند.
    پژوهش فرارو به نقد ادله این سه دسته پرداخته و با الهام از نصوص، به ویژه آیات قرآن، و طبق روش های استنباطی، ادله ایشان را مخدوش دانسته است. این پژوهه در پایان به این نتیجه رسیده که براساس تحلیل درونی موثقه مورداستناد معتقدان به حرمت، دلالت عموم آیه مبارکه 8 سوره ممتحنه و نیز بسیاری از عمومات و اطلاقات قرآنی و روایی دیگر، روایات ناظر به نهی، مخصوص کافران حربی است؛ پس دلیلی بر تعمیم آن به هر غیرمسلمانی وجود ندارد. از این رو، سلام کردن به همه انسان ها به جز کافران حربی امری ستوده است.

    با اضافه شدن فروع جدید به فقه شیعه در دوران فقه تفریعی، اصول جدیدی نیز همراه با آنها به ساختار فقه اضافه شدند. اگرچه منشا برخی از آنها را می توان ازنظر تاریخی تحلیل کرد، اما بخش مهمی از تبعات این رویه تا امروز پنهان مانده است. یکی از این موارد، این پدیده است که متغیری در یکی از ادوار به مباحث یک مسئله اضافه شده و بلافاصله ضمن ورود به اصل مسئله، بر تمامی فروع آن تاثیر می گذارد؛ سپس در گذر زمان، خود به یکی از اصول برای تخریج فروع دیگر تبدیل می شود. این پژوهش می کوشد با تحلیل سیر تکامل فرعی فقهی، از شکل گیری تا تکامل، این تحولات و ضوابط را بررسی کرده و تصویری از آثار و تبعات آن در فقه شیعه عرضه نماید. مسئله ای که این بررسی براساس آن انجام می شود، «تعریف ضوابط و حدود تمکین در بحث نفقه» است. این مسئله با گذراندن مجموعه ای از تحولات، طی دوره های مختلف، دچار پیچیدگی ها و تداخلاتی شده است. با انجام این بررسی، نقش سیر تاریخی رویکرد اصحاب در شکل گرفتن پیچیدگی ها و ابهامات در این فرع روشن خواهد شد.

    امربه معروف و نهی ازمنکر یکی از مهم ترین فرایضی است که کتاب و سنت بر آن تاکید بسیار نموده است. برخی از فقی هان، وجوب این فریضه را شرعی و نقلی دانسته و عقل و عقلا را از ادراک وجوب این فریضه عاجز انگاشته اند؛ اما برخی دیگر قائل به عقلی و عقلایی بودن وجوب این فریضه شده، و آیات و روایات را ارشاد به حکم عقل و عقلا شمرده اند. طرفداران وجوب عقلی و عقلایی به قواعد وجوب لطف، دفع ضرر محتمل، حفظ نظام، شکر منعم، اعانه بر بر و تقوی، و دلایل لزوم منع از تحقق مبغوض مولا و حفظ حدود آزادی تمسک نموده اند. از میان این ادله، قواعد وجوب لطف و اعانه بر بر و تقوی و لزوم منع از تحقق معصیت و مبغوض مولا از اثبات ادعای ایشان قاصر است؛ اما بقیه دلایل می تواند وجوب عقلی و عقلایی این فریضه را اثبات کند. پیداست که دلایل عقلی وجوب فریضه، همان فلسفه حکم شمرده می شوند؛ البته، شبهاتی نیز درباره آن بیان شده که پاسخ داده می شود.

    اندیشوران امامیه و اهل سنت تمایزاتی میان قاعده فقهی و قاعده اصولی ارائه نموده اند. در نوشتار پیش رو، این تمایزات تا پانزده مورد برشمرده و با روش توصیفی تحلیلی تبیین و ارزیابی شده اند. برایند این ارزیابی این است که وجود دو ویژگی در قواعد فقهی، آنها را از قواعد اصولی متمایز می کند: یکم. قواعد اصولی یا در طریق «استنباط» قرار می گیرند یا مجتهد پس از فحص و ناامیدی از دستیابی به دلیل و حجت بر حکم شرعی، به آنها در مقام عمل تمسک می نماید؛ دوم. قواعد اصولی برای مسائل فقهی جنبه آلیت دارند.

    The legislator in Article 282 of the Islamic Penal Code, which was approved in 2003, has enacted that: "the penalty for Moharebeh (the war against Allah) is one of the four following punishments". a. Execution b. crucifixion c. the cutting of the right hand and the left foot d. exile from the land. Then, in Article 283 of the same law, according to one of the two jurisprudential perspectives (Takheer view; which is the freedom to choose one punishment over others) in this view has stated: "The choice in each of the four aforementioned cases in Article 282 is at the discretion of the judge". The judge, in accordance with Article 283, has the absolute power to choose any of the punishments provided in Article 282 for the Mohareb. the legislation of article 283 based on the delegation of absolute power for choosing the punishment to the judge, not only is not the most acceptable jurisprudential view in this regard, but also It has faced serious criticisms such as having conflict with philosophy of legislation for divine punishments and not observing the principle " the proportionality of crime and punishment". It also prevents the unification of the judicial precedent. In contrast to the " Takheer view ", there is another jurisprudential view, called "Tartib (choosing one of the punishments in order)", which, not only it has an index of "the principle of perceived justice in the order view", but it does not have the criticisms in the " Takheer view ". Finally, the current paper calls it necessary to observe the order in punishment, based on the descriptive-analytic method of evaluating reasons and, therefore, it criticizes Article 283 and proposes to amend it.

    Apostasy and its punishment is one of the controversial Islamic rulings. In Shiite jurisprudence, apostasy is divided into two types: Fitri and Milli (A person born to a Muslim parent who later rejects Islam is called a murtad fitri, and a person who converted to Islam and later rejects the religion is called a murtad milli). The most severe punishment for apostasy is related to the male Murtad Fitri which, in addition to the death penalty, also has other specific sentences. Famous Shiite juristss have mentioned two conditions in the definition of Murtad Fitri: First, at least one of the parents must be Muslim at the time of conception; second, the person must have chosen Islam at the time of puberty. There are a number of narrated and non-narrated reasons for the first condition. In this study, it can be clear careful investigation of these reasons that none of them are complete, but the narrations of the jurists indicate the need for parents to be Muslim. This idea is also based on the principle of averting and the rule of reservation.

    The present century which is known as the period of communication and interaction among world cultures, has faced with an evil theory called "the clash of civilizations". In contrast, Islam has emphasized on peace, friendship, convergence, constructive interaction of cultures along with inviting other cultures to its doctrines. Given that, the Islamic strategy at the beginning of communication is "the communication of initiating the greetings", the question is: what is the jurisprudential law of saying hello to non - Muslim? The well-known jurists have regarded saying hello to non - Muslims as Makruh (detestable), and some of them believe that it is Harram (forbidden); also some of them have considered it permissible in the event of its positive influence on making them convert to Islam.
    This study deals with the critique of the arguments in these three groups; and through Islamic text's inspiration such as the Quran verses and based on inferential methods, has considered their evidence as null and void. This study has concluded that according to the internal analysis of reliable hadith attributed to the believers in Taboo and, and the reason for generality of the verse 8 / Momtahena, and many Quranic generalities and absoluteness, the narrations governing on prohibition is special for Kafir Harbi (the belligerent infidel); Therefore, there is no reason to generate it for non – Muslims. Thus, saying hello to all the human beings other than Kafir Harbi is a praiseworthy job.

    With the addition of new corollaries to Shiite jurisprudence during the era of al-Tafri' jurisprudence (the jurisprudence that has the two following features: 1. the inference of issues and subjects in principles. 2. The systematic provision of jurisprudential texts based on Ijtihad and without depending on the text of the principle), new principles were added along with new corollaries to the structure of jurisprudence. Although the origin of some of them can be analyzed historically, but an important part of the consequences in this process has been unknown thus far. One of these cases is the phenomenon in which a variable in one period is added to the topics of an issue and while addressing the issue immediately affects all the branches. Then, over time, it becomes one of the principles to inference the other branches. This study tries to investigate these developments and criteria and illustrate its effects and consequences in Shiite jurisprudence through analyzing the evolution course of jurisprudential branches, from formation to evolution. The study is conducted based on the issue, "the definition of the criteria and limits of obedience in alimony". This issue has been involved in complexities and conflicts over different periods by passing a series of developments. By carrying out this study, the role of the historical course of the companion's approach to the formation of complexities and ambiguities in this branch will be clarified.

    One of the most important obligations that the Holy Quran and tradition have emphasized is "enjoining what is right and forbidding what is wrong". Some Jurists have considered the religious necessity of this obligation to be religious and narrative, and they have considered intellect and intellectuals incapable of perceiving the religious necessity of this obligation. Others, however, have attached the necessity of this obligation of being the rational and intellectual, and have considered the verses and narratives as guides of the command for intellect and intellectuals. The fans of rational and intellectual obligation have resorted to reasons for the principle of grace, the principle of preventing contingent damage, maintaining the system, gratitude for the gifts, contribution to goodness and piety, and the principle for necessity of prevention of being hated by the Lord and maintaining the limitations of freedom. These reasons cannot be proved about the principle of grace, contribution to goodness and piety and the necessity of prevention for being hated by the Lord, but the rest of the principles can be proved by the rational and intellectual reasons, including this obligation. It is obvious that the intellectual reasons for the necessity of obligation is the same as the philosophy of ruling. Of course, there are some doubts about it that are answered in this paper.

    Imamiyyah and Sunni jurists have differentiated between the jurisprudential rule and the rule of Usul. In the following paper, there are up to fifteen distinctions and they are explained and evaluated by a descriptive-analytical method. The result of this evaluation is that the existence of two features in the jurisprudential rules distinguishes them from the rules of Usul. First, the rules of Usul are used either in inference or the Mujtahid resorts to them in practice after doing the research or being disappointed in the achievement of the reason and proof for religious ruling. Second, the rules of Usul for jurisprudential issues are used as a tool.
