    فهم جایگاه دانشگاه ها در سیاست خارجی و نقش آنها در تصویرسازی مثبت از کشور امری حائز اهمیت است. این همان موضوعی است که از آن به دیپلماسی آکادمیک یاد می کنند. برای کشورهایی همچون ایران که ظرفیت قابل توجهی در دانشگاه و علم دارند، این مسئله حائز اهمیت است. با بین المللی شدن آموزش عالی و تسهیل ارتباطات جهانی ناشی از فرایند جهانی شدن، استفاده از ظرفیت های نظام آموزش عالی به مثابه ابزار تاثیرگذار در جهت کسب منافع ملی و افزایش قدرت نرم توسط کشورهای جهان، روزبه روز بیشتر شده است. هر کشوری به فراخور قدرت اقتصادی و فرهنگی خود، روی برنامه های مبادلات فرهنگی و آموزشی سرمایه گذاری می کند. یکی از شاخص ترین و موفق ترین مناطق در این زمینه اروپا است. آنها با ابزار دیپلماسی فرهنگی برنامه هایی مانند تبادلات دانشجویی، بورسیه های تحصیلی، پروژه های بین المللی آموزشی برای دیدارکنندگان خارجی، برنامه های سخنرانی، بازدیدهای علمی را ترتیب داده و با هدف توسعه زبان های انگلیسی، فرانسه و آلمانی و... در حال انتقال ارزش ها و اصول اخلاقی اروپا هستند. در این زمینه، اتحادیه اروپا، دو مزیت دارد؛ یکی داشتن زبان های بین المللی و دیگری کیفیت نظام آموزش عالی.
    این مقاله در صدد پاسخ به این پرسش است که اتحادیه اروپا به شکل عام و کشورهای بریتانیا، فرانسه و آلمان چگونه از ظرفیت های آموزش عالی در افزایش قدرت نرم خود استفاده می نمایند؟ فرضیه ما بر این است که این منطقه با استفاده از ابزارهای دانشگاهی و جذابیت های علمی خود، توانسته است یکی از بیشترین مبادلات آموزشی را در سطح جهان داشته باشد و از این طریق ضمن انتقال ارزش های خود به دانشگاهیان، قدرت نرم خود را افزایش دهد.

    یکی از موضوعات مهم در زمینه امنیت غذایی حفظ حقوق شهروندان غیرنظامی و سایر گروه های جمعیتی در طول مخاصمات مسلحانه بین المللی و غیر بین المللی است. کنوانسیون های چهارگانه ژنو بر این امر صحه گذاشته و این حقوق به عنوان یکی از مبانی حقوق بشر در نسل دوم حقوق بشر می بایست توسط طرفین درگیر در مخاصمه رعایت شود. متاسفانه درطول جنگ یمن، اصل تفکیک نسبت به این موضوع با نقض فاحش از سوی طرفین درگیری به ویژه ائتلاف به رهبری عربستان واقع شده است. در مقاله پیش رو بر آن هستیم تا این موضوع را از بعد رسیدگی حقوقی و کیفری نسبت به حق امینت غذایی در قالب جنایات مقامات نظامی و دولتی مورد بررسی قرار دهیم. بدون شک این موضوع از بعد توسعه پایدار انسانی نیز اهمیت دارد. بر پایه قطعنامه 2216 و نیز ماده 51 منشور ملل متحد، موضوع می تواند در محاکم بین المللی مورد پیگرد قرار گیرد. با همراهی جامعه جهانی، شورای امنیت و مجمع عمومی می توان از طریق صدور قطعنامه و ایجاد صلاحیت جدید نسبت به جرایم علیه امنیت غذایی به صورت تکمیلی و ضمنی، نقض حق بر غذا در درگیری های یمن راقابل پیگری دانست.

    رابرت جرویس در کتاب ادراکات و سوء ادراکات در سیاست بین الملل نقطه تمرکز خود را بر مطالعات روانشناسی و عوامل تاثیر گذار روانی بر رفتار تصمیم گیرندگان سیاست خارجی قرار می دهد. این موضوع یک دیدگاه ترکیبی و انتقادی جدید در تئوری های روانشناسی است که نتایج و یافته های به دست آمده توسط بررسی ادراکات و سوءادراکات بازیگران بین المللی را به روشنی بیان می کند. همچنین این دیدگاه مسیر ارتباط میان آن ها (ادراکات و سوء ادراکات) را برای فهم این موضوع که چگونه تصمیم گیرندگان سیاست خارجی به آن پی برده و در شرایط اضطراری با آن روبرو می شوند را مورد بررسی قرار می دهد.
    جرویس در این کتاب به شرح ادراکات تصمیم گیرندگان در مورد جهان و دیگر بازیگران بین المللی پرداخته که چگونه این مسئله می تواند تصمیم گیرندگان را از حقایق بین المللی دور کرده و مانع رسیدن آن ها به درکی درست نسبت به آنچه هست شود. نویسنده با توجه به وقایع تاریخی بسیاری که در روابط بین الملل رخ می دهد به خوبی نشان می دهد که چگونه این علم می تواند نه تنها به شرح تصمیمات خاص تصمیم گیرندگان، بلکه به شرح رفتار، کنش ها و واکنش های دیگر بازیگران در شرایط اضطراری پرداخته و به طور کلی به بالا بردن فهم بازیگران از رفتار خود، سایر بازیگران و جهان خارج کمک شایان توجهی کند.

    حقوق بشر بین المللی، تعهدات حقوقی را برای حمایت و اجرای حقوق بشر صرفا بر دولت ها تحمیل می کند. بنابراین، دولت ها مسئولیت اولیه در برابر نقض حقوق بشر حتی توسط بخش خصوصی به دلیل حاکمیت انحصاری بر سرزمین دارند. هدف مقاله پیش روی، مشخص ساختن این موضوع است که در چارچوب قواعد حقوق بشر بین المللی، موجودیت های انسانی منفرد به عنوان صاحبان حقوق بشر هستند وحکومت ها حاملان تعهدات اساسی در نظر گرفته شده اند که نقض این تعهدات موجب مسئولیت بین المللی آن ها می شود. اما ماهیت تعهدات دولت ها و اشخاص حقوق خصوصی چیست و در صورت نقض تعهدات، مسئولیت دولت ها و اشخاص حقوق خصوصی براساس قواعد مسئولیت برای اعمال غیر قانونی2001 کمیسون حقوق بین الملل و سایر قواعد بین المللی حقوق بشر چگونه احراز می گردد؟ مقاله با روش توصیفی- تحلیلی با شناسایی مواردی از چالش های اجرای حقوق بشردر صدد است نشان دهد چگونه جامعه مدنی و مکانیزم های حقوق بشر زمینه اجرای تعهدات دولت ها را در این راستا فراهم می سازند.

    فسخ قرارداد از ضمانت اجراهای نقض تعهدات قراردادی در نظام های مختلف حقوقی است که همواره سوالاتی پیرامون چگونگی و شرایط اعمال آن مطرح است. آیا متعهدله طرف قرارداد می تواند اقدام به فسخ نماید یا اختیار اعمال آن با دادگاه است؟ شرایط اعمال فسخ چگونه است؟ مقاله با روشی توصیفی- تحلیلی و تطبیقی این سوالات را در کنوانسیون بیع بین الملل 1980، حقوق ایران و حقوق عراق پاسخ می دهد و وجوه افتراق و شباهت میان آنها را تبیین می نماید. بررسی ها نشان می دهد در حقوق ایران و کنوانسیون اعمال فسخ اصولا با دارنده حق فسخ است ولی در حقوق عراق، قاعده کلی امکان مطالبه فسخ قرارداد از دادگاه است و ارزیابی شرایط فسخ و اعمال آن اصولا با قاضی است. همچنین در کنوانسیون فسخ با اخطار فسخ به نقض کننده تعهد و در زمان متعارف صورت می گیرد و از زمان ارسال یا وصول اخطار به مخاطب نفوذ می یابد لیکن در حقوق ایران اعمال فسخ تشریفات ویژه ای ندارد و فوری نیست. در مجموع فسخ با اراده خود متعهدله و از راه اخطار فسخ با شرایط اقتصادی و خصوصا اقتضائات تجاری بین المللی مناسب تر به نظر می رسد زیرا از سویی با اصل سرعت در تجارت بین الملل تناسب دارد و از سوی دیگر امنیت اقتصادی طرف دیگر را نیز تامین می نماید.

    It is Important to know the place of universities and higher education capacities as the arm of foreign policy and its role in positive image of the state. This function is called academic diplomacy. It can be said that for countries such as Iran, which have a significant capacity in academia and science, this issue is important and the need for serious consideration is there. Considering the global experiences in using higher education capacity in the field of cultural diplomacy and policy in this regard can help to move the path faster. One of the most significant and successful areas in this continent is Europe. Through cultural diplomacy programs such as student exchanges and scholarships, international educational projects for foreign visitors, speech programs, visits to journalists, the development of English, French and German, and the European Union, especially the United Kingdom, France And Germany are moving their values and ethics. In this context, the European Union has two main advantages: one having international languages and another, the quality of the higher education system. The latest figures from the UN Educational, Scientific and Cultural Organization (UNESCO) indicate that the continent is one of the main goals of the world's students. This paper seeks to answer the question of how the European Union in general, and how do the British, French and German countries use higher education capacities to increase their soft power? Our hypothesis is that Europe has been able to enjoy one of the largest educational exchanges around the world, using its academic tools and academic appetite, and, by transferring its values to academics, has increased its soft power.

This is a new hybrid and critical view of psychological theories and explains the results and findings of the study of the perceptions and Misperceptions of international actors. This view examines the perceptions of actors as a viable way to consider politicians' decisions in international developments. In this book, Jervis describes the perceptions of decision makers about the world and other international actors that how perception can remove decision makers from international facts and prevent them from having a proper understanding of what it is. The author, in view of the many historical events that occur in international relations, shows how this science can not only explain the decisions of the decision-makers, but also describe the behavior, actions and reactions of Other actors in emergencies and in general, help pay attention to the actors' understanding of their behavior, other actors and the reality of outside world.

    International human rights impose legal obligations for protection and implementation of human rights solely on governments, so governments have a primary responsibility for human rights violations, even if that violations accrued by the private sector, because of the government's exclusive sovereignty over the land. The purpose of this article is clarifying this issue that within the framework of universal human rights rules, individual human existence as human rights holders and governments are considered a carriers of the basic obligations that violation of these obligations cause national and international responsibility of the state. But what is the nature of these obligations of the governments and private actors? And In case of violation of obligations, what are the responsibility of governments and persons of private law based on the rules of responsibility for illegal acts 2001 International Law Commission and other national and international rules? This paper used analytical method to show some of the challenges of human rights implementation and how civil society and human rights mechanisms provide in this regard implementation of obligations of states.

    Avoidance of contracts is one of the remedies against contractual obligations breach has been adopted in different legal systems. There are some questions about its nature and application conditions. Is a contract be avoided by the promisee or court? How are the conditions for avoidance? The essay with descriptive analytic comparative method answers them under law of Iran, Iraq and United Nations Convention on Contracts for the International Sale of Goods, 1980 and surveys some differences and similarities. The studies propose under Iraqi law, promisee must request the judge to avoide the contract and judge is who decide about avoidance conditions and applying it, but avoidance is applied by the party who has avoidance rightin Iranian law and the Convention. Under the Convention, a notice to who has breached the promise in a reasonable time is necessary and takes effect when the notice is sent or received by the addressee. In Iranian law there is any special formalities and immediacy in this case. Generally, the avoidance with promisee’s autonomy and thorough the notice is more acceptable considering economic conditions and specially necessities of international trade because in one hand it is compatible with speed in international trade and on the other hand, it guarantees the other party’s economic security.
