    وجود یک نظام حقوقی مشخص که حقوق مالکیت و حقوق قراردادها را به خوبی تعریف نماید می تواند نقش مهمی در کاهش هزینه های انعقاد قرارداد داشته باشد. شمال شبه جزیره عربستان در روزگار پیش از ظهور اسلام فاقد قانون مالکیت و قانون قراردادها و در نتیجه یک نظام حقوقی مشخص بود و همین امر هزینه های انعقاد قرارداد را در وضعیت نامساعدی قرار می داد. هجرت پیامبر(ص) به مدینه زمینه های مناسبی را برای معرفی آموزه های حقوقی اسلام ایجاد کرد. البته این سوال مطرح است که با توجه به منع کتابت حدیث و مکتوب نشدن تعالیم حقوقی اسلام در سده اول هجری، آیا مجموعه تعالیم حقوقی اسلام می توانست نقش یک نظام حقوقی را در کاهش هزینه های انعقاد قرارداد ایفا نماید. چنانکه در پاسخ نشان خواهیم داد مکتوب بودن آیات الاحکام و نیز حضور کبار و صغار صحابه که خود مستقیما و یا با یک واسطه از تعالیم حقوقی اسلام آگاهی یافته بودند و نیز نقش آنان در اداره دادگاه ها می توانست تا حدود زیادی خلا مذکور را پر نماید. به علاوه تعالیم مذکور گستره وسیعی از مسائل حقوقی به ویژه مسائل مرتبط با حقوق مالکیت و حقوق قراردادها را در بر می گرفت. بدین ترتیب با توجه به مجموعه شواهد و مدارک تاریخی و فقهی می توانیم این فرضیه را که «اسلام نظام حقوقی مشخصی را طراحی و معرفی نکرده بود» رد نماییم.

    در سال های اخیر استفاده گسترده از اوراق مشتقه بسیار فراگیر شده است بگونه ای که بداعت و گستره استفاده از آن امروزه بر هیچ فعال اقتصادی در کشورهای توسعه یافته پوشیده نمانده است. در این تحقیق برآنیم تا دو روش از روش های پوشش ریسک نوسانات ارزی با نام قرارداد آتی ها و اختیار معامله ارزی که در بازارهای مشتقه رایج می باشند را با رویکرد فقهی مورد بررسی قرار دهیم. اما ابتدا ماهیت حقوقی ارز را به عنوان دارایی پایه این قراردادها مورد شناسایی قرار می دهیم. بنابراین بعد از ذکر توضیح درباره ماهیت حقوقی ارز و مبانی نظری بازارهای آتی ها و اختیارات ارزی، به بررسی فقهی این معاملات خواهیم پرداخت و در نهایت خواهیم گفت که استفاده از این ابزارها به خودی خود، از نظر شرعی جایز است ولی برای اجرایی نمودن استفاده از این ابزارها لزوم اعمال شرایط سخت گیرانه قانونی اصلی انکار ناپذیر است.

    اصناف توزیع کننده کالا و خدمات از دیرباز سهم قابل توجهی را در اداره امور اقتصادی به خود اختصاص داده اند. از اینرو توسعه متناسب این بخش عظیم از نظام اقتصادی، امری اجتناب ناپذیر است. نظام اقتصادی اسلام ضمن برخورداری از عالی ترین اهداف، آموزه های سودمند و کارآمدی را شامل می شود. توسعه نظام صنفی برای رسیدن به یک الگوی صنفی اسلامی مساله ای است که به گواهی تمدن اسلامی، برای یک جامعه اسلامی با اهداف متعالی خود از اهمیت فوق العاده ای برخوردار بوده و توسعه آن بسیار ضروری است. اما در عمل شاهدیم، با گسترش اصناف و تحولات متعدد در سایر بخش های اقتصادی و غیر اقتصادی، بسیاری از آموزه ها و ارزش های اسلامی در حوزه تجارت به فراموشی سپرده شده و از اینرو لزوم بازنگری آن در حوزه های سیاستگذاری و اجرا، امری اجتناب ناپذیر شده است. برای دستیابی به نظام صنفی توسعه یافته از منظر اقتصاد اسلامی باید به هر یک از چهار رکن اجرای آموزه های فقهی و اخلاقی اسلام در حوزه اصناف، سیاستگذاری و برنامه ریزی صحیح اقتصادی، نظارت صحیح بر واحدهای صنفی و مکان یابی، همچنین فضاسازی صحیح بازارها و اماکن صنفی جامه عمل پوشاند.

    تمایزی که فیلسوفان مسلمان میان گزاره های حقیقی و اعتباری می افکنند، نقطه عزیمت این نوشتار است. بر اساس این تفکیک، اقتصاد از جمله دانش های اعتباری است که رسالت اصلی آن ارائه سیاست ها و تدابیر بهینه در حوزه روابط معیشتی است، البته توصیه ای مبتنی بر شناخت های واقعی. همچنین مانند دیگر علوم اعتباری، شاخص تایید یا رد سیاست های اقتصادی، نسبت آن با عدالت (اعطاء حقوق) است. در این نگرش عدالت اقتصادی وصف آن موقعیت مطلوبی است که حقوق اقتصادی به نحو کامل ادا شود. ریشه شناخت حقوق و عدالت نیز واقعیت خارجی است یعنی غایت یا قابلیتی که در خلقت جهان و انسان درج شده است.
    بر اساس مطالب مقاله، دانش اقتصاد شامل یک رکن اعتباری (شامل اهداف و حقوق اقتصادی) و یک رکن حقیقی (شامل دو دسته شناخت های بنیادین و تجربی اقتصادی) است. روش شناسی اقتصاد متعارف از هر دو معیار عدالت (در رکن اعتباری) و صدق یا واقع گرایی (در رکن حقیقی) به دور است، حال آنکه آموزه های اسلام می تواند هم در رکن اعتباری و هم در رکن حقیقی اقتصاد اثرگذار باشد، به نحوی که معرفت اقتصادی حاصل، در بخش های قابل توجهی متمایز از معرفت رایج بوده و قابل اتصاف به وصف اسلامی باشد.

    بی تردید فرد مسلمانی که می خواهد در فضای شریعت قرار گیرد با محدودیت هایی برای انجام مصارفش روبرو است. در واقع شریعت اسلام با آموزه های خود در قالب کتاب و سنت معصومین(ع)، بایدهای رفتار مصرفی فرد مسلمان را تبیین نموده و اهداف و انگیزه های او را نیز مطابق با این آموزه ها، در او نهادینه می کند. شناخت درست از قوانین و مقرارت و همچنین محدودیت های مصرفی یک فرد مسلمان در چارچوب دین اسلام، برای تبیین الگوی مصرف نقش حیاتی دارد. در این تحقیق تلاش شده است ضمن شناخت این عوامل به بررسی پیش فرض ها و مفروضات این الگو پرداخته شود و یک الگوی مصرفی مستقل در اسلام متفاوت از الگوی مصرفی سرمایه داری را اثبات نمود. سوالات و فرضیه های این تحقیق در مورد وجود الگوی مصرف مستقل است که مفروضات و محدودیت های متفاوت از مفروضات و محدودیت های موجود در الگوی مصرف سرمایه داری را می طلبد. روش انجام این تحقیق نیز توصیفی، تحلیلی و اسنادی بوده است و از اسناد مربوطه به صورت کتاب، مقاله و پایان نامه استفاده شده است. در این تحقیق این نتیجه بدست آمده است که عمده مفروضات و محدودیت های فرد مسلمان متفاوت از یک انسان اقتصادی در نظام سرمایه داری است و از اینرو الگوی مصرف اسلامی با توجه به محدودیت ها و مفروضات خاص خود شکل می گیرد. در الگوی مصرف اسلامی، یک فرد مسلمان درآمد خود را ابتدا به مصارف خود شامل مصارف واجب اختصاص می دهد. درآمد مازادی را که بعد از مصرف فرد مسلمان باقی می ماند، می تواند به انفاق اختصاص یابد یا سرمایه گذاری گردد. اگر بازده سرمایه گذاری درآمد مازاد بر مصرف برای مصرف کننده مسلمان بزرگ تر از پاداش مصرف آخرتی آن باشد، در آن صورت درآمد مازاد بر مصرف خود را سرمایه گذاری می کند. اما اگر بازده سرمایه گذاری درآمد مازاد بر مصرف کوچک تر از پاداشی باشد که مصرف کننده مسلمان به علت مصارف اخروی آن در ذهن دارد، درآمد مازاد خویش را انفاق می نماید.

    جان راولز از بزرگترین فلاسفه سیاسی در حوزه عدالت اجتماعی و شهید مرتضی مطهری از بزرگترین متفکرین اسلام شناس قرن بیستم می باشند. گرچه هیچ یک از این دو اندیشمند به نام یک اقتصاددان معروف نمی باشند، اما در آثار آنان می توان معیارهای قابل تاملی را برای توزیع عادلانه اقتصادی پیدا نمود. راولز معتقد بود که توزیع امکانات اولیه به خصوص آزادی های اساسی باید به طور برابر صورت گیرد. وی نابرابری های توزیعی را به دو شرط دریافت به میزان تلاش مشاغل و توزیع به نفع پائین ترین طبقات مورد پذیرش می دانست. از سوی دیگر شهید مطهری نظام توزیع در سه مرحله توزیع برابر امکانات اولیه، توزیع متناسب با استحقاق افراد در درآمد به وجود آمده و بازتوزیع دارائی ها به منظور ایجاد توازن اجتماعی را مطرح نموده اند. فرادینی بودن ذات عدالت، توزیع مساوی امکانات اولیه، توزیع به میزان استحقاق افراد و توجه به طبقه ضعیف جامعه از مهمترین نقاط تشابه و منشا مشروعیت عدالت، نقش بازتوزیع اقتصادی و نیز مفهوم آزادی ها از مهمترین نقاط تمایز در بین دیدگاه های این دو متفکر معاصر می باشد.

    The existence of a specific legal system, which precisely defines property rights and contract rights, can play an important role in reducing the Contracting Costs. Before the advent of Islam, Northern Arabian Peninsula lacked the Property and Contract Laws and, consequently, a specific legal system. Thus, the contracting costs in that era were high. The migration of the Prophet Mohammad (PBUH) to the Medina created a suitable environment for the introduction of the Islamic legal doctrine. However, the question is: whether the Islamic legal teachings could play the role of a specific legal system in reducing contracting costs despite the prohibition of writing hadith and consequently the verbal status of the Islamic legal teachings in the first century AH. However, we should not forget that in this century the legal verses of the Holy Quran were written and many of the senior and junior Companions (Sahabah) were alive and have determining role in managing Islamic courts, the facts that prevented a legal gap in the first century AH. Islamic legal teachings contain a wide range of legal issues, especially issues related to property rights and Contract rights. So by relying on the vast historical and jurisprudential evidence we can reject the hypothesis that “Islam did not design and introduce a specific legal system”.

    One of the evolutions in financial markets has been the propagation of contract instruments that are called financial derivatives. “Option currency” and “Futures currency” are among cases that are allocated to the main share in these markets. Paying attention to the nature of these contracts and available jurisprudential resources can help legal inferences about the use of these contracts.There are sufficient attempts about “option” and “futures” contracts which are mentioned in this study briefly. Here we study these currency contracts theoretically and derive juridical statute about them. To justify the non-spot currency contracts in Shariah outlook, it is necessary to show the juridical nature of currency at first. Despite the correctness of the non-spot currency contract among countries, the above-mentioned conclusions are obtained. We show that the nature of these contracts is acceptable at Shariah point of view, but some restrictions should be applied for using these contracts in our capital market.

    Guilds of distribution of commodity and services play an important and meaningful role during the periods of Iran’s economic activities. So, the appropriate development of this system is necessary. The Islamic economic system besides having enough efficiency has supreme teachings and goals. The development of guilds system in order to reach an Islamic guild system is a phenomenon which according to the Islamic civilization is of great necessity. However, with the development of guilds and the various changes in the economic and non-economic sectors, many Islamic teaching and values in trading and commerce are fading away. So, the review of guilds system in policy making and implementing the policies is necessary. For reaching a developed guild system from an Islamic point of view the following factors should be put under consideration: 1. implementing the Islamic jurisprudential and moral Islamic teachings in the guilds system 2. Correction of policy-makings and plans 3. Correction of the supervision strategies and 4. reforming the design of commercial places.

    Muslim philosophers’ distinction between factual and conventional statements is the point of departure for this article. Based on this separation, economics is considered practical knowledge, which its main mission is handling the welfare problems and providing policies to solve them through understanding factual relationship (finding is an introduction to handling). Similar to other practical or social kinds of knowledge, the most important criteria to confirm or reject economic policies are considered according to their relation with justice. According to realist methodology, the recognition of rights has its roots in the real world and objectivity: natural capacity and ends and human labor. According to the article, economic knowledge includes two pillars: conventional statements (goals and economic rights) and factual statements (assumptions and positive relations). Methodology of the mainstream economics is far from the criterion of justice (on conventional side) and criterion of realism (on factual side). However Islamic teachings could affect real assumptions and also economic rights and goals. Thus according to these two channels we can speak about different economic knowledge based on the real conception and just handling

    God has given boundless gifts unsparing to man. Since God created man, only God had full knowledge of the existence of man’s structure and mechanism. So, all laws and regulations are justified in the form of religion for promoting man’s status. From consumption aspect, there are laws and regulations for humans that have placed them in a special framework of principles and have ensured their success in moving according to this framework. Undoubtedly, a Muslim who wants to act according to religion is faced with some restrictions about his consumption. In fact, Islam as a religion should explain the Muslims’ consumer behavior and institutionalize their motives and goals within the framework of Holy Quran and Sunnah (Islamic Tradition). Accurate knowledge of laws and regulations and consumption constraints on a Muslim as an individual consumer, in the framework of Islam are crucial in determining the pattern of Islamic consumption. In this research it is tired to survey the axioms and assumptions of this pattern and to outline the factors which affect this pattern. Since these factors, axioms, assumptions and constraints are the cause of the behavior of Muslim and non-Muslim consumers, major differences between the behavior of Muslim consumer and the behavior of an individual in conventional economics have been surveyed. These differences had proven an independent consumption patterns in Islam which are different from capitalistic consumption patterns. The questions and hypothesises proposed in this research, are about independent consumption patterns for Muslim individuals which are different from the constraint, axioms and assumptions in capitalistic consumption pattern. The method of this study is descriptive, analytical and documental, and relevant documents, articles and theses are used in preparing this paper. Also, for analyzing the Muslims’ consumer consumption behavior, an Islamic society has been considered; so the consumption behavior of a real society is not analyzed. In this study, it is revealed that the main axioms and assumptions and constraint of a Muslim vary from a person in capitalist economic system, hence the Islamic consumption pattern is formed according to its own limitations and axioms. In the Islamic consumption pattern, a Muslim at first allocates his income to his necessary expenses, then the remained, can be allocated to Enfagh or be invested again as more Enfagh in the subsequent periods for satisfying the necessary consumptions in an optimal form.

    John Rawls is one of the biggest political philosophers in social justice field and Shahid Morteza Motahari is one of the Islamic Scholars in 20st century. Although none of them is economist, there are noteworthy criterions of economic just distribution in their works. Rawls believed the initial facilities-particularly basic freedoms-should be distributed equally. He accepted the unequally distributions provided that incomes and efforts move proportional to each other and his inclination was toward the lowest income levels. Furthermore, Shahid Motahari described equal initial facilities distribution, distribution according to the people’s merit and assets redistribution based on social harmony as three stages of distribution system. Considering the nature of justice as something beyond religion, the equal initial facilities distribution, according merit distribution and the regard to the low-income people are the important similar points; and the origin of legitimacy of justice, economic redistribution role and concepts of freedoms are the important different points of these two thinkers’ viewpoints.
