    عقد صلح به عنوان یکی از مهم ترین عقود در فقه و حقوق اسلام جایگاه ویژه ای دارد. جریان خیار شرط در این عقد با توجه به خاصیت پایان بخشی صلح به نزاع حاصل از معاملات، مورد تردید فقی هان امامیه واقع شده است. ایشان با این استدلال که صلح برای رفع نزاع در معاملات تشریع شده و لزوم آن حکمی است، جریان خیار را در عقد صلح ممنوع دانسته اند. این پژوهش با رویکردی تحلیلی به نقد ادله مانعان پرداخته و در پرتو اصولی چون حاکمیت اراده در عقود، از جریان خیار شرط در صلح حمایت می کند.

    از مرجحات مطرح شده در باب تزاحم این است که واجبی که دارای بدل نیست بر واجب دارای بدل مقدم می گردد. در مورد اثبات این کبرای کلی دلایل و وجوهی در علم اصول مطرح شده است و برای این کبرا و ضابطه کلی، دو مصداق به عنوان تطبیق بر این قاعده بیان شده است. در این جستار با واکاوی چهار دلیل از وجوهی که برای اثبات کبرا بیان شده و سپس بررسی دو مصداقی که مطرح گردیده است، به این نتیجه رسیده ایم که اگر واجب، دارای بدل عرضی باشد، اصلا تزاحمی پدید نخواهد آمد و موضوعا از محل بحث خارج است و اگر واجب، دارای بدل طولی باشد، در دو مقام باید بحث شود:الف) در مورد اثبات کبرا در باب مرجحات باب تزاحم باید گفت: این مورد به عنوان ضابطه ای مستقل در مرحجات با تزاحم قابل قبول نیست بلکه باید در هر موردی مساله به صورت مستقل مورد بررسی قرار گیرد و تمام ادله و وجوهی که برای تقریب این ضابطه کلی بیان شده اند، دچار خدشه هستند.
    ب) در مورد دوران امر بین طهارت خبثیه و طهارت حدثیه باید گفت: نمی توان به روشنی از ادله استفاده نمود که در طهارت مائیه، قدرت شرعی اخذ گردیده است و لذا نمی توان از باب این ضابطه بر تقدم طهارت خبثیه بر طهارت حدثیه حکم نمود بلکه باید به دلیل دیگری تمسک نمود؛ در مورد دوران امر بین درک تمام نماز با تیمم در وقت و ادراک یک رکعت از نماز با وضو در وقت هم تنها به دلیل آن که درک کردن تمام نماز در وقت اهم است، تیمم کردن بر وضو گرفتن مقدم خواهد بود.

    درباره چیستی «مهر» دیدگاه های مختلفی وجود دارد. برخی «مهر» را عوض و برخی هدیه دانسته اند. این مقاله با رویکردی تحلیلی و اجتهادی و با توجه به نظریات حقوقی در پی تبیین واقع بینانه این مقوله هماهنگ با منطق قرآن، روایات و موازین فقه و حقوق اسلامی است. نخست با توجه به مترادف های واژه «مهر» در لغت و کتاب و سنت، تصویری ابتدایی از «مهر» به ذهن مخاطب می بخشد و سپس با بحث عمیق و استدلالی در باب ماهیت عقد نکاح به پاسخ به این سوال اساسی می پردازد که آیا نکاح یک عقد معاوضی است تا «مهر» رنگ و بوی عوض پیدا کند و یا عقدی غیر معاوضی؟ سپس با رجوع به منابع فقه اسلامی بویژه قرآن و روایات اهل بیت (علیهم السلام) وارد بحث چیستی شناسی «مهر» می شود و وجوه گوناگون این نهاد چند وجهی را بیان می کند و به نقد و بررسی آنها می پردازد و پس از واکاوی این معنا به اختصار به ماهیت «مهر» در نکاح موقت که مشروع و مورد امضای پیامبر اسلام (صلی الله علیه و آله) است، می پردازد. بحث از ماهیت «مهر» علاوه بر ثمره نظری، ثمره عملی نیز در بردارد که در بحث کیفیت تقسیم یک مهر برای دو همسر ظاهر می شود.

    در فقه اسلامی برای احقاق حقوق قربانی و متهم در جرائم مربوط به نفس و عضو، شرایطی در نظر گرفته شده است پرسش این است که آیا امکان تبعیض در قصاص عضو وجود دارد به این معنا که مجنی علیه و یا ولی، نسبت به جانی، بخشی از قصاص را اجرا و بخشی دیگر را عفو یا مصالحه کند؟ در این مسئله سه دیدگاه فقهی وجود دارد: یک- تبعیض در قصاص کلا پذیرفته شده است. دو- تبعیض در قصاص، تنها برای مرد قابل پذیرش است. سه- بر پایه قول به تفصیل در قطع چهار انگشت زن توسط مرد، زن می تواند دو انگشت مرد را به عنوان قصاص قطع کند و چیزی به عنوان مازاد بر دیه به مرد رد نمی کند، ولی وی نمی تواند سه انگشت مرد را قطع و یک انگشت را عفو کند. در این تحقیق با نقد دو دیدگاه اول و دوم، قول به تفصیل پذیرفته شده است.

    در مواردی که شخصی طبق یک قرارداد متعهد به ترک یک تصرف اعتباری می شود، بعضی از فقی هان به استناد قاعده اصولی دلالت نهی بر فساد، بر این باورند که تصرفات منافی صحیح نیست، در برابر دیدگاه مذکور، تعداد زیادی از فقی هان و دانشیان اصول فقه در مجموع با استناد به چهار دلیل ادعا کرده اند حکم وضعی تصرفات منافی با تعهد قراردادی صحت است. در این مقاله هر چهار دلیل مذکور به صورت تحلیلی بررسی و رد شده است.

    مشهور در میان فقها آن است که می توان با تکیه بر «اخبار من بلغ» حکم به استحباب اموری کرد که امارات و روایاتی نا معتبر، بر مطلوبیت انجام آن ها دلالت کند. ایشان با بهره گیری از این اخبار با رویکرد فقهی و اصولی، به این نتیجه رسیده اند که آن چه در روایات دلالت کننده بر احکام الزامی، شرط است، در روایات دلالت کننده بر احکام غیر الزامی شرط نیست. این در حالی است که با درنگ در سمت و سو ومفاد این اخبار و بررسی قرائن دیگر، روشن می شود مضامین آن ها، مرتبط با موضوع ثواب و پاداش الهی است و بیشتر صبغه کلامی و اعتقادی دارند و نمی توان آن ها را دلیل بر ملغا بودن شرایط حجیت اخبار دلالت کننده بر مستحبات و فضائل دانست و بر این اساس، فتوا به استحبات (وکراهت) به سان فتوا به وجوب و حرمت، نیازمند دلیل معتبر است.

    در خصوص اجرای اصل عملی– به هنگام شک در نفسی بودن و غیری بودن یک واجب - میان اصولیان اختلاف نظر وجود داشته و دیدگاه های گوناگونی مطرح است تا جایی که آخوند خراسانی تقسیم بندی دوگانه ای را ابداع کرده و سرانجام مرحوم نائینی، تقسیم بندی سه گانه ای را مطرح نموده که مورد پذیرش اکثریت علما قرار گرفته است. لیکن در این تحقیق، به تقسیم بندی سه گانه جدیدی می رسیم که در آرای علما مسبوق نبوده و به گونه ای حاصل تلفیق تقسیمی است که خوئی و نائینی ارائه کرده اند.

    ساختارگرایان، از جمله توماس کوهن، به نقش ساختارها در تولید علم معتقدند و تاریخ علم را تاریخ دوره هایی می دانند که از هم کاملا گسسته هستند و شاخصه هر دوره ای از تاریخ علم، ظهور پارادایمی جدید است که نظریه های علمی درون آن تولید شده و ظهور پیدا می کند. طبق این رویکرد، پیشرفت علم در قالب زنجیره ای خاص صورت می گیرد که حلقه اول آن را پیش علم (شبه علم) تشکیل می دهد؛ حلقه دوم را کارکرد علم متعارف، حلقه سوم را بحران علم متعارف، حلقه چهارم را انقلاب علمی و در نتیجه حلقه پنجم یعنی بروز علم متعارف جدید صورت می گیرد. مبتنی بر این مدل می توان چرایی مواجهه علمای شیعه با اخبار آحاد را در ادوار مختلف تاریخ تشیع مورد ارزیابی قرار داد. به عنوان مثال سده پنجم تا هفتم را باید عصر حاکمیت پارادایم «اصالت قرائن» دانست. این پارادایم فقط در دو برهه، یکی آغاز پیدایش خود (مرحله پیش علم) و دیگری دوران اضمحلال خود (مرحله بحران علم متعارف) دارای مخالفینی بود و در بین این دو مقطع ما شاهد حاکمیت بلامنازع پارادایم «اصالت قرائن» هستیم و هیچ عالمی را نمی یابیم که قائل به حجیت اخبار آحاد باشد؛ تا اینکه با فعالیت های علامه حلی و حلقه فکری ایشان، یک انقلاب علمی (تغییر پارادایم) صورت می گیرد و پارادایم «اصالت سند» بر فضای علمی مسلط و حاکم می شود و تا زمان ظهور اخباری گری این سلطه را حفظ می کند.

    Contract by compromise has a special status as one of the most important contracts in jurisprudence and Islamic law. Given the quality of terminating compromise over the conflict resulting from transactions, the event of option of condition in this contract has been dubious to the Imāmiyya jurisprudents. Arguing that compromise has been legislated for eliminating conflict in transactions and its necessity is preceptive, they have considered option in contract by compromise as prohibited. With an analytical
    approach, this article has critiqued the proofs of those maintaining prohibition and has supported the event of option of condition in compromise in the light of such principles as sovereignty of will in contracts

    Among the preferences brought up on tazāḥum (disturbance, conflict) is that the obligation that does not have a substitute becomes precedent over the obligation possessing substitute. Concerning the proof of this universal major, there are evidences and aspects brought up in methodology of Islamic jurisprudence and two referents have been brought up for this universal major and rule as verification to this principle. In this research, by exploring into four reasons for the aspects stated for proving the major and then study of the two referents that are brought up, it is concluded that if the obligation possesses latitudinal substitute, there would occur no tazāḥum and it stands out of question; and if the obligation possesses a longitudinal substitute, two positions are to be discussed:A. It should be said concerning the proof of major on preferences in the section of disturbance: this case is not acceptable as an independent criterion in preferences with disturbance; rather, the issue should be studied independently in every case and all the evidences and aspects that are stated for approximation of this universal criterion are discredited.
    B. Concerning the vacillation between impure (khubthiya) purification and ritual impurity (ḥadathiya) purification, it should be stated that: one cannot clearly use evidences that legal authority is acquired in water purification and thus one cannot make a judgment concerning this criterion for the precedence of khubthiya purification over ḥadathiya purification; rather, one should appeal to another evidence: concerning the vacillation between full performance of on-time prayer with tayammum (ablution with earth or sands) and performance of one rak‘a of on-time prayer with wuḍū (ablution with water), performing tayammum would be precedent to wuḍū only because full performance of on-time prayer is more important

    There are different viewpoints concerning the quiddity of mahr; some have viewed mahr as exchange and some as gift. With an analytical and jurisprudential approach and with respect to the legal opinions, this article seeks to give a realistic explanation of this category consistent with the Qur’an, traditions, and standards of jurisprudence and Islamic law. First, with respect to the synonyms of the term mahr by definition and in the Qur’an and traditions, it gives the reader a preliminary portray of mahr and then with a deep and argumentative discussion of the nature of marriage contract undertakes to answer the question as to whether marriage is an exchange contract so that mahr would find a color of exchange or is it a non-exchange contract. Then it enters the discussion of getting to know the quiddity of mahr by referring to the Islamic jurisprudence sources, especially the Qur’an and traditions of Ahl al-Bayt (A.S.) and critically reviews them; after exploring into this concept, it touches upon the nature of
    mahr in temporary marriage, which is legitimate and endorsed by the Prophet of Islam (S.A.W.). Discussing the nature of mahr would yield not only theoretical but also practical benefits as well, as it appears in discussion about the quality of dividing a mahr for two spouses

    In Islamic jurisprudence, some preconditions have been taken into consideration for restoring the rights of the victim and the accused in crimes related to homicide and organ defect. The question is whether there is the possibility of discrimination in qiṣāṣ (retaliated punishment) for body organs; that is to say, can the victim or the claimant execute part of qiṣāṣ and forgive or compromise another part in regard to the criminal? There are three legal views concerning this issue: 1. Discrimination in qiṣāṣ is quite accepted; 2. Discrimination in qiṣāṣ is accepted only for men; 3. According to the view on detail in cutting off four fingers of a woman by a man, the
    woman can cut of two fingers of the man as qiṣāṣ and does not pass on something as blood money (dīya) to the man. But she cannot cut off three fingers of the man and forgive one finger. In this research, the first and the second viewpoints are critiqued and the view on detail is accepted

    In the cases in which, according to a contract, the person is committed to abandon a conceptual appropriation, some jurists believe, according to the uṣūlī principle denoting prohibition of corruption, that contradictory appropriations are sound. In contrast to the above viewpoint, many of the jurists and scholars of principles of jurisprudence have in general claimed with reliance on four reasons that situational ordinance of contradictory appropriation with contractual commitment are sound. In this article, all the above-mentioned four reasons are analytically studied and rejected.

    It is popular among the jurists that by relying on man balagh traditions (whose origin is not clear but acting upon them is rewarding), one can make judgments on matters that some invalid ordinances and traditions denote the desirability of acting upon them. Employing these traditions with a legal and uṣūlī approach, they concluded that whatever is precondition in traditions denoting the obligatory ordinances are not precondition in traditions denoting the non-obligatory ordinances. In the meantime, by deliberating on the details and content of these traditions and studying other evidences, it becomes clear that their contexts are related to the Divine reward and
    punishment and are more of theological and ideological tone and cannot be proofs for cancellation of the preconditions for the authority of traditions denoting preferable religious acts and virtues; and thus, giving fatwa for desirability (or aversion), like giving fatwa for obligation or unlawfulness, requires valid proof

    There has been disagreement among uṣūlīs concerning the execution of the practical principle – at the time of doubt whether an obligatory is nafsī (for itself) or ghayrī (for another) – and various viewpoints are brought up, to the extent that Ākhūnd Khurasanī has devised a double division and finally, the late Nā’īnī devised a triple division that has been approved by the majority of scholars. In this research, however, we have achieved a new triple division, which has been unprecedented in the opinions of the early scholars and is, in a way, a combination of the divisions presented by Khū’ī and Nā’īnī.

    Structuralists, including Thomas Kuhn, believe in the role of structures in knowledge production and view history of science as the history of periods totally torn apart. They believe that the criterion for any period of history of science is the emergence of a new paradigm, within which the scientific theories are developed. According to this approach, science development takes place within a specific chain, whose first link consists of pre-science (pseudo-science); the second link consists of function of conventional science; the third link consists of conventional science crisis; the fourth link consists of scientific evolution; and consequently the fifth link takes place as the incidence of new conventional science. Based on this model, the reason for the Shī‘a scholars’ encounter with the isolated traditions can be evaluated in various periods of the history of Shi’ism. For instance, the period from fifth to seventh century should be known as the age of the sovereignty of the paradigm of “principality of evidences”. This paradigm has had some opponents only in two stages, one at the beginning of its emergence (pre-science stage) and the other during its dissociation (conventional science crisis stage) and between these two stages we witness the indisputable sovereignty of “principality of evidences” and find no scholar who has believed in the validity of isolated traditions. Only then, with the scholarly activities of ‘Allāma Ḥillī and his thought circle, a scientific revolution (change of paradigm) takes place and the paradigm of “principality of sanad” prevails and dominates over the scholarly climate and maintains this domination until the appearance of traditionalism
