    مرگ مغزی اصطلاحی پزشکی و به معنی توقف غیر قابل برگشت کلیه اعمال مغزی است. از آنجا که در قواعد حقوق اسلامی، واقعیت مرگ و حیات، موضوع حکم شرعی قلمداد شده، احراز مرگ مغزی در جهت رعایت حدود الهی حائز اهمیت می نماید؛ فقی هان معاصر اهل سنت دیدگاه های مختلفی در این باره بیان داشته اند که به سه گروه موافقان و مخالفان مرگ مغزی و گروه بینابین تقسیم می شوند. برخی از فقی هان، مرگ مغزی را از جهت حرمت نفس انسانی و بر اساس اصولی، چون اصل استصحاب و ملاحظه عرف عام، مرگ مسلم ندانسته و به دنبال آن جداکردن دستگاه های احیا کننده از بیمار و برداشت اعضای او را جایز نمی دانند، ولی گروه دوم، مرگ مغزی را از باب فقدان حیات انسانی و بر اساس نظریه کمیسیون پزشکی که همان عرف خاص است، مرگ مسلم و جداکردن دستگاه های احیا از بیمار و برداشت اعضای او را جایز می دانند و برخی دیگر مرگ مغزی را یکی از مصادیق مرگ قطعی می دانند، ولی از جهت برخی احکام فقهی حقوقی فرد دچار مرگ مغزی شده را در حکم میت به شمار نمی آورند.

    قدرت ضبط ادرار و مدفوع از مهم ترین منافع و قابلیت های بدن انسان به شمار می روند. گاه آسیب دیدگی برخی از اعضای بدن همچون سیستم نخاعی، موجب اختلال در کارکرد این منافع می گردد. این اختلال ها به دو شکل ریزش و احتباس ظهور می یابند. عارضه ریزش ادراری و مدفوعی در فقه امامیه، تحت دو عنوان «سلس بول» و «عدم ضبط مدفوع» مورد بررسی قرار گرفته اند. همچنین قانونگذار در مواد مختلف به خصوص ماده 704 و 705، میزان دیه این دو نوع عارضه را مقرر کرده است. با این همه، مساله احتباس ادرار و مدفوع که به گواه پرونده های موجود در پزشکی قانونی، شیوع نسبتا فراوانی دارد، هم در فقه و هم در قانون مجازات، مسکوت مانده است. در این نوشتار، با استناد به دو دسته روایت عام و خاص که منطبق بر مساله احتباس می باشند و نیز تعمیم تعلیل ترتب دیه کامله بر ریزش ادراری، ثبوت دیه کامله برای احتباس ادراری یا مدفوعی در صورت غیر مقطعی و مداواناپذیربودن آن معین گشته است.

    حفظ سلامت جسم و روح انسان همواره مورد توجه شریعت اسلام بوده است، یکی از مواردی که با سلامت جسمی و سلامت عقلی انسان ارتباط مستقیم دارد، حکم به حرمت شرب خمر است. فرضیه ی این پژوهش بر این مطلب استوار است که عمدتا حرمت های شرعی در خصوص ماکولات، مشروبات، ملبوسات و سایر موارد، دارای حکمت های علمی از جمله حکمت های پزشکی می باشد که علوم مختلف از جمله پزشکی به آن دست یافته و یا در آینده به آن نائل می شود.پژوهش پیش رو با روش توصیفی تحلیلی و با بررسی آیات و روایات حرمت شرب خمر از یک طرف و تطبیق آن بر یافته های پزشکی از طرف دیگر درصدد ارائه تئوری تلازم میان حرمت های شرعی و منع های پزشکی است.از جمله یافته ها این که یکی از مصادیق این تلازم، تلازم میان شرب خمر و آثار مخرب و مضر آن است که علم پزشکی نیز موید حرمت خمر و آثار مخرب آن است.مطالعه حکمت ها و اسرار علمی حرمت شراب و آثار شراب خواری در آیات و روایات و تطبیق و تایید آن توسط یافته های علم پزشکی، به این مهم رهنمون می سازد که این موضوع در واقع به نوعی یک معجزه علمی قرآن و اسلام است. شراب خواری دارای آثار مخرب و زیان بار جسمانی، مانند پیدایش مشکلات کلیوی، قلبی عروقی، گوارشی و آثار مخرب روحی و روانی، مانند کینه توزی، بداخلاقی، کمبودهای روحی و روانی و بسیاری از حوادث شوم نفسی دیگر در انسان ها می شود، هرچند که برخی معتقدند شرب خمر دارای فوایدی می باشد و به آیه 219 سوره بقره که در آن از منافع شراب سخن گفته شده استدلال می کنند.

    تحقیق حاضر، حکم فقهی تعیین جنس جنین را مورد بررسی قرار داده است. تعیین جنس جنین به شیوه امروزی، از مسائل نوظهور پزشکی است. تعیین جنس جنین آن است که والدین با انجام اقداماتی قبل از انعقاد نطفه، جنس مورد نظر خویش را انتخاب نمایند تا از به دنیاآمدن نوزادان مبتلا به بیماری های ژنتیکی وابسته به جنس پیشگیری نموده و یا اگر جنس خاصی از فرزند مد نظر والدین باشد، از تعیین جنس جنین استفاده کنند. برخی از فقها با استناد به آیه 49 سوره شوری مخالف این کار می باشند، ولی موافقان تعیین جنس جنین با استناد به آیه 5 سوره مریم، خواستن یک جنس خاص را جایز دانسته اند و برخی نیز قائل به توقف شده اند. با بررسی های انجام شده می توان گفت که با پیروی از رژیم غذایی خاص و برای سالم بودن نسل از برخی امراض ارثی، در صورت وجود ضرورت و اصل اباحه قبل از لقاح در صورتی که به مادر ضرری نرسد، جایز است از روش تعیین جنس جنین استفاده نمود.

    افزایش مبتلایان به بیماری های غیر قابل درمان و به تبع آن، مرگ تدریجی از یکسو و لزوم جبران زیان وارده مطابق اصل جبران خسارت و همچنین وجود ابهام در قوانین موجود از سوی دیگر، اندیشمندان حقوقی را بر آن داشته تا در این راستا به حل مساله بپردازند. از آنجا که عمده قواعد و قوانین حقوقی کشور ما، مبتنی و تنظیم شده بر اساس قواعد و مبانی فقهی امامیه است و این قواعد می توانند نسبت به مسائل جدید، راه گشا باشند، این مقاله با استفاده از روش مطالعه توصیفی تحلیلی و با هدف تبیین و تحلیل قواعد فقهی که می توانند مبنای مناسبی در زمینه جبران خسارات ناشی از عوامل مرگ تدریجی باشند، به رشته تحریر درآمده است.برخی قاعده لاضرر را برای اثبات ضمان کافی می دانند، در حالی که این قاعده تنها جهت رفع حکم ضرری، تشریع شده است نه اثبات حکم ضمان. قاعده اتلاف و تسبیب به ترتیب در مواردی که ورود آسیب با واسطه و بدون واسطه باشند، جریان می یابند. برخی قاعده غرور را تنها در صورت عالم بودن غار جاری می دانند، در حالی که این قاعده در هر دو صورت عالم بودن و جاهل بودن غار جریان دارد. طبق بررسی و مطالعات انجام یافته، قواعد اتلاف، تسبیب و غرور در مساله جبران خسارات ناشی از عوامل مرگ تدریجی نقش مهمی دارند که می توان با استناد به این قواعد، اشخاص را در صورتی که سبب انتقال بیماری به اشخاص دیگر شوند، مسوول جبران خسارات دانست.

    آمیزش میان زوجین گاه به صورت متعارف (وطی در قبل) و گاه به صورت نامتعارف (وطی در دبر) انجام می شود که این استمتاعات آثار و پیامدهایی هم از لحاظ پزشکی و هم از لحاظ فقهی دارد. از نظر پزشکی آمیزش نامتعارف اثرات سوئی همچون ابتلا به برخی امراض و انتقال بیماری ها، بی اختیاری مدفوع در زن و... را به دنبال دارد. از لحاظ فقهی نیز این نوع آمیزش نامتعارف (وطی در دبر) بر مساله عده، که یکی از موارد مهم در حوزه حقوق خانواده است تاثیرگذار است. در این نوشتار به این مساله پرداخته شده که آیا عده طلاق برای مطلق نزدیکی وضع شده است یا این که فقط مربوط به نزدیکی در قبل که روش آمیزش متعارف است، می باشد؟ این بحث به نحوی در قسمت ابتدایی ماده 1155 ق.م نیز مطرح شده و از آن وجوب عده برای مطلق نزدیکی برداشت می شود. در میان فقها نیز مشهور قریب به اجماع بر این باورند که بر انثای مطلقه در صورت نزدیکی چه از قبل باشد و چه از دبر، عده واجب است؛ قائلان به وجوب عده در صورت وطی در دبر به دلایل لفظی و لبی استناد جسته اند. نگارندگان با بررسی و نقد هریک از این ادله به این نتیجه دست یافته اند که وجوب عده تنها مرتبط به حالت نزدیکی در قبل است و نزدیکی در دبر ذیل حکم وجوب عده قرار نمی گیرد. با توجه به نتیجه فقهی فوق، می توان ماده 1155 ق.م را نیز اصلاح نمود.

    Brain death is a medical term and it means the irreversible stop of the brain. Since in Islamic law, the reality of death and life is considered the subject of a religious order, so it is important to achieve brain death in order to observe the divine limits; the contemporary jurisprudents of the Sunni Orthodoxy have expressed different opinions about it, which are divided into three groups of supporters and opponents of brain death and the middle class are divided. Some jurisprudents do not consider brain death to be deserving of respect for the human soul and according to the principles, such as the principle of presuming continuation of the status quo ante, and the observance of the common parlance, is not absolute death, and therefore does not allow the separation of the resuscitation devices from the patient and the bringing out their members, but the second group, brain death from the directing the lack of human life and according to the theory of the medical commission, which is the same special custom, it is considered to be a dead end it is permissible to separate the devices of resuscitation from the patient and to bring out their members, while others consider brain death as one of the examples of definitive death, but from the direction Some legal jurisprudential rulings do not consider a person who has a brain death to be a dead corps.

    The power of retaining urine and feces are considered to be important benefits and abilities of the human body. Occasionally, damage to some body organs, such as spinal cords may lead to some disorders in function of these benefits. These disorders appear in two forms: cramps and leakage. The complication of urinary and fecal leakage has been studied under two headings of ''Smooth Urine'' and ''un-retention of feces'' in Imamyia Jurisprudence. Also, the legislator in various materials, especially Articles 704 and 705, has been provides the amount of blood money for these two types of complications. Yet as the forensic cases show, the issue of urinary and fecal cramps, which is a relatively high prevalence, has remained unanswered, both in jurisprudence and in the penal code. In this paper, based on two general and specific narrations that are complies with the issue of cramps and generalizing the blood money of urinary leakage, as well as the generalization of the logical and linguistic analysis of successive order of full blood money of urinary leakage and affirmation of full blood money has been determined for urinary and fecal cramps if those are permanent and incurable.

    Maintaining the health of human body and soul has always been the subject of the Islamic law. One of the issues that directly affects physical and mental health is forbidden to drink alcohol. The hypothesis of this research is based on the fact that mainly religious sanctities for eating, drinking, wearing and other items have a scientific wisdom, including the wisdom of medicine, which various sciences, including medicine, have achieved or will achieve in the future. The present study uses a descriptive-analytical method, and by examining the verses and narrations of forbidden drinking alcohol on the one hand and its adaptation to medical findings, on the other hand, it seeks to present a theory of dependency between religious sanctities and medical precautions. As a result, one example of this dependencies is the dependency between alcohol drinking and its destructive and harmful effects which is confirmed by medical science. The study of the wisdom and scientific reasons of forbidding drinking alcohol and the effects of alcohol drinkers on verses and narrations, and its adoption and confirmation by the findings of medical science, leads to this fact which is in fact a kind of scientific miracle of the Quran and Islam. Alcohol drinking has harmful effects, such as the emergence of kidney, cardiovascular, digestive and psychological harmful effects such as harassment, indifference, mental and physical deficiencies, and many other fatal incidents in humans, although some believe that alcohol drinking is beneficial and argues in verse 219 of the Baqara chapter in which it is spoken of in the interests of alcohol.

    The present study investigated the jurisprudential ruling on the determination of the sex of the fetus. The determination of the fetus in the modern way is one of the emerging issues of medicine. The determination of the sex of the fetus is that the parents, choosing their gender, by taking steps before coagulation of the sperm in order to prevent the birth of newborns with genetic diseases related to the sex or if the parents have considered the particular gender of the child, uses the determination of the embryo. Some jurisprudents, referring to verse 49 of surah al-Shoura, oppose the work mentioned above, but the advocates of determining the sex of the fetus, according to verse 5 of the surah of Maryam, have permitted the desire for a particular gender, and some have also ceased to exist. It can be said that by following a special diet and for the health of the generation of some hereditary diseases, it is permissible to use the method of determining the sex of the fetus if it is necessary and if there is permission before fertilization if it does not hurt the mother.

    Increasing the incidence of incurable illnesses, and consequently the gradual death of both, and the need to compensate for the damage caused by the principle of compensation, as well as ambiguity in existing laws, on the other hand, have led lawyers to resolve the problem in this regard. Since most of our country's legal rules and regulations are based on the rules of jurisprudence of the Imamites, these rules can be helpful in dealing with new problems, This article has been written using a descriptive-analytic study method with the aim of explaining and analyzing jurisprudential rules that can be used as a basis for compensating for the consequences of gradual deaths. Some consider the Principe of no harm as sufficient for proving indemnification, while this rule is set forth only to eliminate the harm, rather than proof of the bail. Rules of wasting and causation run in cases where damage entry is mediated without mediation. Some believe that the rule of deception applies only when a person intentionally inflict harm on others; however, this rule applies in both cases, whether the harm is inflicted intentionally or unintentionally. According to studies, Rules of wasting, causation and deception in the issue of compensating for the causes of gradual death are important factors that can be cited by these rules, individuals who are responsible for transmitting disease to other people, are responsible for the compensation.

    Sexual relationship between couples sometimes happens in the usual way (Sex through the vagina) and sometimes in an unusual way (anal sex), which has medical and jurisprudential effects. Anal sex has harmful effects on both man and woman such as transmission of diseases, incontinence of feces in woman, etc. from the point of jurisprudence, anal sex can have effects on Term of widowhood which is an important subject in family law. In this paper this question is asked whether the Term of widowhood of divorce is for absolute sex or it is just related to sex through vagina. This discussion has somehow been raised in the first part of Article 1155 of the Civil Law, and it is considered necessary for the absolute closeness. Among the wellknown jurists there is a consensus that the divorced woman should take Term of widowhood if she had each kind of sex.People who has this idea citing verbal and non-verbal reasons. The authors, with a deep examination and critique of each of these arguments, have concluded that the necessity of Term of widowhood is only related to the state of sex through vagina, and the anal sex doesn’t require Term of widowhood. In view of the above jurisprudential result, it is possible to amend Article 1155 of the Civil Law.
