    در مواردی به حکم قانون برای شخصی نسبت به مبیع، حق شفعه پدید می آید و او می تواند با پرداخت معادل ثمن به خریدار، مبیع را تملک نماید. گاه قبل از اعمال حق شفعه توسط شفیع، خریدار نسبت به مبیع معامله ای انجام داده و آن را از مالکیت خویش خارج می نماید. حال سوال این است که قبل از اعمال حق شفعه، وضع حقوقی معامله چگونه بوده و اعمال حق شفعه چه تاثیری بر آن دارد. در پاسخ به این سوال، در مورد وضع حقوقی معاملات مشتری قبل از اعمال حق شفعه، نظر مشهور، صحت معاملات مشتری است. در عین حال نظریه «عدم نفوذ» نیز طرفدارانی دارد. درباره تاثیر اعمال حق شفعه بر معاملات پیش گفته نیز باید گفت در میان کسانی که معاملات مزبور را قبل از اعمال حق شفعه صحیح می دانند، گروهی اعمال حق شفعه را سبب انفساخ معاملات مشتری دانسته اند. دسته دیگر امکان ابطال معاملات را مطرح کرده و گروهی نیز از عدم قابلیت استناد معاملات مشتری در مقابل شفیع سخن گفته اند. جستار حاضر ضمن طرح دیدگاه های مختلف و نقد و بررسی آن ها، به این نتیجه دست یافته که نظریه «وضعیت مراعی» راه حل مناسب تری برای بیان وضع حقوقی معاملات مشتری قبل از اعمال حق شفعه و نیز تبیین تاثیر اعمال آن بر معاملات مزبور است.

    مطابق قاعده «الثمن لا یوزع علی ها الشروط»، فقها معتقدند که شروط هیچ مابازایی از ثمن معامله را به خود اختصاص نمی دهند، بلکه تنها خاصیت شروط، ایجاد انگیزه و رغبت در مشتری برای خرید مشروط است. این در حالی است که فقها در جای دیگر مدعی اند که «للشرط قسط من الثمن»؛ بخشی از ثمن در ازای شروط پرداخت می شود. در واقع ظاهر این دو قاعده با یکدیگر ناسازگار است. لذا در مباحث متعددی از منابع فقهی، فقها اختلاف نظر دارند که محل نزاع، مشمول کدام یک از این قواعد می باشد؟
    فقها پس از مشاهده تناقض نمایی این دو قاعده، به شیوه های مختلف سعی کرده اند که میان این دو جمع کنند، اما به نظر می رسد عرف در مواردی که شرط، اعم از شرط صفت و فعل و نتیجه، جنبه رغبت افزایی داشته باشد، بخشی از ثمن را در مقابل آن قرار می دهد، اما در مواردی که شرط، اصل باشد یعنی نفس معامله برای تحقق این شرط واقع شده باشد، عرف در اینجا ثمن را تقسیط نمی کند.

    در این مقاله اصل آزادی ایقاعات در فقه امامیه و حقوق ایران بررسی شده است. در پژوهش حاضر با این پرسش روبه روییم که آیا در حقوق و فقه ما اصل آزادی ایقاعات پذیرفته شده است یا خیر و قلمرو نفوذ اراده یک جانبه تا کجاست. در پاسخ باید گفت که در حوزه حقوق غیر مالی اراده یک جانبه به ایقاعات معین محدود می شود اما در محدوده حقوق مالی و در عرصه حقوق عینی باید اصل آزادی ایقاعات را در تملک مباحات جاری دانست، ولی تملک مال غیر ویژه اخذ به شفعه است. تملیک یک جانبه مال به دیگری نیز مختص وصیت است و قاعده ای عام نیست. در مقابل، اعراض از حقوق عینی طبق قاعده است. در حقوق دینی نیز پیدایش یک طرفه تعهد برای خود و به نفع دیگری امکان ندارد و ایجاد تعهد به ضرر دیگری نیز مختص وصایت است ولی ابرای دین مطابق قاعده است. در فرجام جستار پیشنهاد شده است که قانون گذار مدنی بابی مستقل را به شرایط اساسی صحت ایقاعات و قواعد عمومی آن ها اختصاص دهد و احکام و آثار ایقاعات معین را مشخص سازد.

    یکی از مهم ترین مسائل طلاق، عده است که بیشتر جنبه تکلیفی دارد. ممکن است عده، امری تعبدی باشد، یعنی زن بعد از انحلال ازدواج باید مدتی صبر کند تا مجاز به ازدواج مجدد باشد. با توجه به روایات اهل بیت و بر اساس شکل پیوند و گسست در امر ازدواج، می توان اقسام هشت گانه ای را برای عده تصور نمود که هر یک نیز ممکن است افراد متفاوتی داشته باشند. در برخی از موارد که امکان آن مربوط به زمان بعد از نزول قرآن و ورود سنت است، در آیات قرآن و سنت صراحتی دیده نمی شود.
    اصل عده، ادله محکم و خدشه ناپذیر فقهی دارد و دارای اقسام متفاوت و احکام ویژه ای است، ولی در صورت دستیابی به فلسفه عده، شاید بتوان از این طریق به برخی پرسش های مطرح شده پاسخ گفت. هرچند درک فلسفه تشریع احکام، فضیلتی است که به افزایش بصیرت انسان نسبت به احکام دین می انجامد و در اصل وجوب عمل به احکام نقشی ندارد.
    توجه به ویژگی مشترک زنانی که عده ندارند یعنی استبرا و پاک بودن رحم از فرزند و توجه به اینکه مرد در مدت عده می تواند به زن رجوع کند و زندگی زناشویی را از سر بگیرد، به خوبی می رساند که هدف مهم آن جلوگیری از جدایی کامل بین زن و شوهر و متلاشی شدن کانون خانواده است.
    نوشته پیش رو با مراجعه به آیات و روایات و بررسی اقوال فقی هان می کوشد تا با کشف ملاک و حکمت تشریع، به پرسش های مرتبط پاسخ گوید.

    شمول ولایت نسبت به همه عالمان فقه، مولد پرسشی جدی است که آیا پذیرش چنین شمولی، بدون محدود کردن حوزه فعالیت هر فقیه، موجب نمی شود که فقی هان یک زمان، بر اساس تشخیص خود در کار یکدیگر دخالت نمایند؟ جواز این دخالت ها که «تزاحم ولایت ها» خوانده می شود، شبهه به وجود آمدن هرج و مرج و اختلال نظام را در پی دارد. فقی هان در پاسخ به این پرسش، نظریه های متفاوتی را ارائه کرده اند. برخی، تزاحم را جایز ندانسته و اشکالاتی بر آن وارد کرده اند و بعضی دیگر، شمول ولایت را پذیرفته، اشکالات را پاسخ گفته اند. نتیجه نهایی در این موضوع به مبانی اصل ولایت فقیه بستگی دارد. اگر مستند ولایت فقیه را دلایل لفظی بدانیم، تزاحم ولایت ها در عرصه مسائل کلان حکومتی به دلیل «انصراف ادله» و نیز تمام مواردی که به هرج و مرج می انجامد، جایز نیست و در سایر موارد، دلیلی بر حرمت آن نداریم. اما چنانچه ولایت فقیه را از باب «امور حسبیه» و قدر متیقن پذیرفتیم، تنها هرج و مرج است که محدوده جواز و عدم جواز تزاحم را تعیین می کند. هر دخالتی که باعث هرج و مرج شود، ممنوع و سایر دخالت ها و تزاحم ها مجاز خواهد بود. مقتضای اصل عملی در آنجا که فقی هان متعددی همزمان دارای شرایط ولایت هستند، «جواز تزاحم فقی هان» می باشد.

    ضمانت اجرای شرط ضمن عقد به طور سنتی، الزام مشروط علیه و سپس حق فسخ عقد است. محدودیت در این ضمانت اجرا هم موجب تزلزل رابطه قراردادی میان طرفین عقد می شود و هم مخالف مقتضای عدالت است. مطالبه بهای شرط، ضمانت اجرای عادلانه ای است که این کاستی را جبران می نماید. بر اساس نظریه «مطالبه بهای شرط»، مشروط له پس از تخلف مشروط علیه و ممکن نبودن اجبار وی، حق دارد بها و قیمت شرط را از او مطالبه نماید. نظریه فوق مبتنی بر تقابل شرط و عوض، عمومیت ارش، اصول لزوم قراردادها و قاعده لاضرر است. قاعده عدالت و عرف هم موید این ضمانت اجراست. در تعیین خسارت قراردادی به طور کلی و بهای شرط به طور خاص، دو روش را می توان اعمال نمود؛ روش عینی و روش ذهنی. در روش عینی که نمود نظم گرایی در تعیین بهای شرط می باشد، شیوه های معینی برای جبران خسارت توسط قانون گذار یا مفسر قانون توصیه می شود. اما در روش ذهنی، تعیین خسارت بر اساس ارزیابی دادرس از خسارت واردشده بر متضرر و به هدف جبران کامل خسارت صورت می پذیرد. در نحوه تعیین بهای شرط، با توجه به مبنای منتخب، روش عینی ترجیح دارد. هرچند در مواردی همچون تعیین بهای شرط نتیجه و شرط صفت غیر مالی دیدگاه ذهنی اولویت می یابد.

    از شرایط صحت معاملات، مالیت شرعی داشتن مبیع است. بر این اساس، در امکان معامله کردن حقوق معنوی از حیث مالیت عرفی و شرعی آن، اختلاف است. البته خود این مسئله، مستلزم بررسی مشروعیت اصل حقوق معنوی است؛ زیرا حسب ظاهر، خلاف اصول و قواعدی همچون تسلیط و... است.
    مقاله پیش رو، ضمن گردآوری و بررسی دیدگاه های محققان، به این نتیجه رسید که ماهیت فقهی حقوق معنوی، اگر از موضوعات نوپدید باشد، مشروعیت آن حسب اصل صحت و قواعد عمومی قراردادها اثبات می شود. ضمن آنکه با اثبات نوپدید بودن حقوق معنوی، از دلیل سیره عقلا نیز می توان حسب تقریری، برای نیل به مشروعیت حقوق معنوی بهره جست. اما در صورت نوپدید نبودن، حسب جایگاه عرف در تغییر موضوعات و احکام و یا نهایتا در قالب شرط ضمن عقد (شرط ترک فعل)، مشروعیت آن اثبات شدنی است. به دنبال اثبات مشروعیت اصل حقوق معنوی، مالیت عرفی آن نیز همچون مالیت بسیاری از حقوق رایج در نزد عرف، استنتاج شدنی است؛ زیرا ملاک ها و شاخص های عرفی و عقلی برای مالیت داشتن اشیا در آن وجود دارد و شارع نیز این مالیت را پذیرفته است، لذا حقوق معنوی از حیث داشتن مالیت شرعی، بدون اشکال است.
    مهم ترین دستاورد این تحقیق اثبات نوپدید بودن حقوق معنوی است،به طوری که با بیان دلایل عقلی تفصیلی، وجود آن در زمان شارع را امر محال عرفی می داند. نیز به ملاک یابی مالیت داشتن اشیا و تطبیق حقوق معنوی بر این ملاک ها می پردازد.

    اصل رضایی بودن عقود، استثنائاتی دارد که آن ها را عقود تشریفاتی می نامند. بیشتر حقوق دانان معتقدند که این اعمال به علت عدم حصول به نفس اشتراط، در قالب شرط نتیجه امکان پذیر نیستند. در جستار حاضر به این موضوع پرداخته می شود که ضرورت ندارد شرط نتیجه به نفس اشتراط حاصل شود و یا دست کم لازم نیست که مسبب و نتیجه آن اعمال به نفس اشتراط حاصل شود بلکه حتی اگر مقتضی آن عمل حقوقی هم ایجاد شود کافی است. برای این مدعا می توان به دلایلی استناد جست؛ از قبیل دلالت اقتضا و مفهوم مخالف ماده 236 قانون مدنی و همچنین شرط نتیجه معلق که قانون گذار مدنی در ماده 1119 و موادی دیگر پذیرفته است. از آثار آن می توان به ایجاد نوعی حق عینی برای مشروط له به نفس اشتراط، و همچنین ایجاد تکلیفی به لحاظ رفع مانع (ایجاد سبب خاص) به عهده مشروط علیه برشمرد.

    In some cases, it is established the right of pre-emption (shufa’a) for a person relating to the sale by the law of rule. He can refund the sale price to the purchaser and possesses the sale. Some times before exercising the right of pre-emption (shufa’a) by the pre-emptor, the purchaser has carried out a transaction in relation to the sale and he has no longer the owner of the sale. Here the question is what the legal status is before exercising the right of pre-emption (shufa’a) and what the effect of exercising the right of pre-emption (shufa’a) is on it. To respond to this question about the case of legal status of the transactions of the buyer before the exercising the right of pre-emption (shufa’a), the general outlook of the Islamic jurisprudents is the validity of the transactions of the buyer. But the attitude of ineffectiveness has proponents. About the effectiveness of the exercising the right of pre-emption (shufa’a) on the pre-mentioned transactions (muamalat), it should be said that among those believe the validity of the mentioned transactions (muamalat) before exercising the right of pre-emption (shufa’a), some believe that exercising the right of pre-emption (shufa’a) causes the legal involuntary annulment of the transactions of the buyer (the cancelation of the transaction happens legally without the will of the buyer). Others have propounded the possibility of the annulment of transactions (muamalat) and some others have stated unenforceability (Inopposabilité) of the transactions of the buyer before the pre-emptor. The present research meanwhile observing different attitudes and criticizing and studying them has achieved this consequence that the theory of the situation of waiting -observing- for another legal affair (the legal status from the point of the contract requirements has no problem but the obstacle has caused the transaction to be kept until the determination of the other affair) a better solution to present the legal status of the transactions of the buyer before exercising the right of pre-emption (shufa’a) and the determination of its impact on that mentioned transactions (muamalat).

    According to the Islamic legal maxim that the sales price is not allotted for conditions, the Islamic jurisprudents believe that conditions do not allocate a portion of transaction price for themselves, but the only specialty for conditions is to motivate customers’ desire and interest to stipulated shopping. Whereas the Islamic jurisprudents in other situation claim that there is a portion of the price for conditions (shart). Apparently there is disagreement between these two Islamic Legal Maxims. Therefore, in different issues of the Islamic jurisprudential sources, the Islamic jurisprudents have different attitudes and argue the position of the conflict contains which of these two Islamic legal maxims. After observing this paradox, The Islamic jurisprudents try to conjoin these two Islamic legal maxims in various methods. But it seems that convention considers a portion of the price for conditions in cases which conditions (included provision of adjective, performance of an act and result) have the form of the arousal of interest but in cases which provisions is origin (base) it means that transaction itself to fulfill the provision, the price is not fractionated by convention in these cases.

    This paper has studied the principle of freedom in one sided (unilateral) contracts in law of Iran and imamiyyah Jurisprudence. The present research has confronted with this question if the principle of freedom in one sided (unilateral) contracts is accepted by the law of Iran and Islamic jurisprudence or not and to where the realm of free Will effectiveness is. To answer this question, it should be stated that one sided free-will is restricted to identified (specific) ones sided (unilateral) contracts (Iq’aa) in the realm of non-financial rights. But in the scope of financial rights and in the area of objective rights, the principle of freedom in one sided (unilateral) contracts should be carried out in the ownership of actions (neither forbidden nor recommended-mubah), but the ownership of third party property (the ownership of property is for another person) is specified to pre-emption (shufa’a). One sided conveyance (transferring property from one owner to another) is specified to Will (Wasiyyat) and it is not a common rule. In contrast, abandonment (the surrender, relinquishment, disclaimer, or cession of property or of rights) is from of real rights according to the rule. it is impossible the establishment of one sided obligation for himself and for the benefit of the other in personal rights and creating obligation for the loss of the other is specific to guardianship established by will but legal release of obligation Is accorded with the rule. Finally, it is suggested that the civil legislature specifies an independent chapter to the basic provisions of the validity of one sided (unilateral) contracts and common rules and determines rules and definite (identified) effects of one sided (unilateral) contracts.

    One of the most important issues of divorce is iddah (waiting period) which has mostly the aspect of duty (taklifi). It is possible to be a devotional act. It means after the legal dissolution of a marriage, women should observe for period to permit to remarry. With respect to the words of Ahl al-Bayt and with the form of dissolution and partnership, iddah can be divided to 8 types which each of them can have different parts. In some cases which its possibility relates to the time of descending the Quran and entrance of Sunnah, it is not observed the clearness in the noble Quran and Sunnah. The reality of iddah has undisputed Islamic jurisprudential evidences and has different types and special Islamic verdicts but if it is possible to access the philosophy of iddah, perhaps through this way it is possible to answer some propounded questions. Although understanding the philosophy of the establishment of Islamic ordinances is an advantage which helps to the enhancement of man insight to the Islamic divine decrees and it has no role in the reality of the obligation of carrying out Islamic ordinances. Considering the common features of women who do not have iddah means purification and clearance of their wombs from children (to ensure the woman is not pregnant) and regarding that man (her husband) can return to her divorced wife without a new marriage contract during the period of iddah, it indicates well that the important goal of iddah is to prevent complete separation between man and woman and destruction of family. The following paper with studying the verses of the noble Quran and Islamic traditions and examining the Islamic jurisprudents’ words tries to answer the related questions to it with exploring the criterion and purpose (hikmah) of establishing iddah.

    The inclusion of the authority to all Islamic jurisprudential jurists creates a serious question if the acceptance of such inclusion (without restricting the realm of the activity of every Islamic jurist) does not cause the Islamic jurists to interfere in each other’s functions according to their recognition at the same time. Permissibility of such interferences which is called the interference of authorities follows doubt that it creates chaos and turmoil in the system. The Islamic jurists have presented different theories to respond this question. Some have not allowed the interference (tazahum) and stated some problems and some others have accepted the inclusion of such Velayat and have answered the Problematic issues. The final result relates to the bases of the principle of the guardianship of the jurist or velayat-e faqih. If the evidence of the guardianship of the jurist or velayat-e faqih is verbal reasons, the interference of authorities in the field of the major governmental issues is not permitted because of establishing chaos and turmoil and there is no reason to be prohibited in other cases. But if it is accepted from the point of Hisbiya Affairs (Al-Umur al-Hisbiya) and the stage of certainty, only chaos and turmoil is the spectrum of permissibility or impermissibility determines the interference (tazahum). Any interference which makes chaos and turmoil is prohibited and the other interferences are permissible. The requirement of practical principle where there are several Islamic jurisprudential jurists who have the stipulation of governance is the permissibility of the interference (tazahum) of faqihan.

    The guarantee of performance of the clause within a contract traditionally is the obligation of one who is the contract against and then the right of voidance or cancellation of the contract. The limitation in this executive guarantee causes the instability of the contractual relationship between contracting parties and it is also against the requirements of justice. Demanding the price of the provision is a just executive guarantee which compensates these damages (fault). According to the theory of “demanding the price of the provision”, after the violation of one who is the clauses against and not being possible to be obliged, the one who is the condition for is right to ask the price and the price of the provision. This theory is based on the balance of the provision and consideration, the generality of arsh (the compensation for a defect or the payment of a monetary indemnity), the principles of the exigency of the contracts, and the principle of no harm (la-tharar). The principle of justice and convention also emphasizes this guarantee of performance. Two methods can be applied to determine the contractual damages totally and the price of the provision specifically: objective method and subjective method. In objective method which is an indication of disciplinism in determining the price of the provision, the definite (identified) methods are recommended to compensate damages by the legislature or the interpreter of the law. But in subjective method, determining the damages is based on the estimate of the judge for the damage to the lost party to provide complete monetary compensation for loss. It is preferable the objective method to determine the price of provision with respect to the chosen base. Although in some cases such as determining the price of the non-financial result and adjective provision, the subjective attitude takes priority over the objective one.

    The legitimate property of commodity (sold things or the subject of sale) is one of the stipulations of the validity of transaction. Therefore, there is disagreement in possibility of conducting intellectual rights from the view of conventional and religious property. It is necessary to study the legitimacy or validity of the principle of the intellectual rights because it is apparently contrary to principles and rules such as control (taslit). Meanwhile gathering and studying the opinions of the scholars, the following paper has resulted that the Islamic jurisprudential nature of the intellectual rights if it is an emerging subject, its validity according to the principle of the validity and public rules of contracts is proved. Meanwhile proving the neo-intellectual rights, it is possible to achieve the legality of the intellectual rights by using the conducts of wise men according to some statement. But if it is not new, according to the position of convention in the change of issues and decrees and lastly in the form of a clause (a condition within a contract) -negative condition- it is provable the legitimacy or validity of it. After proving the legitimacy of the principle of the intellectual rights, it can be resulted its conventional property like finances of many other customary rights among people. Because there is conventional and intellectual criteria and parameters for lawfully permissible benefit of properties according to Shari’ah in it and it is accepted by God. Therefore, the intellectual rights from the point of lawfully permissible benefit according to Shari’ah has no problem. The most notable achievement of this research is proving neo-emerging of intellectual rights as it is conventional impossible to be in the time of the Holy Legislator also establishing parameters of lawfully permissible benefit of properties according to Shari’ah and be accorded with the intellectual rights with these parameters.

    The principle of the consent in contracts has exceptions which are called contracts by deed or formal contracts (tashrifati contracts). Most of the jurists believe that these acts are impossible in the form of the provision of result because of not accessing the nature of stipulations. The present note argues that it is not necessary for the provision of the result to achieve the nature of stipulations or at least it does not need that the outcome and result of those acts achieve to the nature of stipulations but even if the requirement of that legal act is established, it is adequate. It should be stated some evidences (reasons) for this claim such as the indication of the requirement and the divergent meaning (Mafhum al-Mukhalafah) of Article 236 of the Civil Code and also the provision of the contingent result which the civil legislature has accepted in Art. 119 and other Articles. From its effects, it can be mentioned the establishment of a type of objective right for one who is the clauses for because of the nature of stipulations and also creating duties because of taking away the obstacle (creating special cause) for one who is the clauses against.
