    پس از جنگ جهانی دوم تحولات بنیادینی در زمینه حقوق بین الملل به وجود آمد. در این دوران جامعه ملل با حجم گسترده ای از معاهدات روبه رو است که معاهدات حقوق بشری قسمت عمده ای از آن را تشکیل می دهد. معاهدات حقوق بشری به عنوان یکی از بنیادهای اصلی حقوق بین الملل از ارزش دوچندانی برخوردار هستند. ماهیت حمایتی این اسناد اقتضا دارد که چارچوب تحلیلی متفاوتی در ارتباط با مسائلی همچون ایراد حق شرط از سوی کشورها نسبت به آنان اتخاذ گردد. کنوانسیون رفع اشکال هرگونه تبعیض علیه زنان به عنوان مهم ترین سند حقوقی مربوط به زنان از بیشترین میزان حق شرط در بین اسناد حقوق بشری برخوردار است، بخش قابل توجهی از حق شرط های انشا شده ناظر بر مواد بنیادین کنوانسیون است که در وهله اول کلی است و در وهله دوم موضوع و هدف این کنوانسیون را به چالش می کشاند. به همین رو، بررسی این حق شرط ها در چارچوب موازین حاکم بر حق شرط بر اساس کنوانسیون معاهدات 1969 از اهمیت ویژه ای برخوردار است. در مطالعه پیش رو با بررسی هدف و فلسفه تدوین این کنوانسیون به مطالعه مقوله حق شرط در این سند از سوی کشورهای اسلامی و اروپایی به عنوان یکی از اصلی ترین معاهدات حقوق بشری می پردازیم.

    نژاد و قومیت، اساس ایدئولوژی سیاسی اسرائیل را تشکیل می دهد. به گونه ای که استفاده ابزاری آنان از شریعت یهود زمینه نژادپرستی مذهبی و قومی رژیم صهیونیستی را فراهم کرده است. رژیم صهیونیستی خود را تنها دولت یهودی در جهان قلمداد کرده و کوشیده است، بر روی همه شکاف های اجتماعی و سیاسی اش، هویتی واحد برای خود دست و پا کند. ورود این تفکر در عرصه بین الملل موجب چند دستگی شده است و می توان ادعا کرد ریشه منازعات چند سال اخیر در خاورمیانه و حتی فراتر از آن به نژادپرستی اسرائیل مرتبط است. در این تحقیق تلاش شده تا به این پرسش پاسخ داده شود که ریشه نژاد پرستی در عملکرد رژیم صهیونیستی چیست؟ در پاسخ به این سوال این فرضیه به آزمون گذاشته می شود که ایدئولوژی نژادپرستی رژیم صهیونیستی بر پایه تحریف آیین یهود و تلاش این رژیم در راستای تسلط بر سایر ملل استوار شده است.

    زنان کارگر به عنوان یکی از قشرهای مورد حمایت اجتماعی، در معرض آسیب های گوناگونی قرار دارند. به همین دلیل، حمایت های خاص از زنان کارگر در اسناد مختلف بین المللی از جمله اسناد حقوق بشری و نیز مقاوله نامه های سازمان بین المللی کار درج گردیده است. تساوی حقوق میان زنان و مردان کارگر از اصول بدیهی است که باید در تمام نظام های حقوقی مورد احترام قرار گیرد. در حقوق داخلی، مقررات قانون کار، قانون اساسی و اسناد بالادستی حمایت های مناسبی را در خصوص کارگران زن به رسمیت شناخته اند. یکی از موضوعات نوین مطرح شده توسط سازمان بین المللی کار، مفهوم کار شایسته است که بر اساس آن، کار باید بر مبنای احترام به کرامت و شان انسانی باشد. بر این اساس، سازمان بین المللی کار، برنامه ها و اهداف کار شایسته را در کشورهای مختلف دنبال می کند. کشور هند یکی از این کشورها است که برنامه جامعی را برای کار شایسته پیاده می کند. در این اثر، به طور تطبیقی به وضعیت حمایت از زنان کارگر در حقوق هند و ایران از دریچه کار شایسته می پردازیم.

    با توجه به وضعیت نظام بین المللی موجود، برخی ابعاد حقوقی مداخله بشردوستانه با توجه به حاکمیت کشورها بر منابع طبیعی شان و خصوصا مقوله محیط زیست و نظریه های رو به افول بودن حاکمیت مطلق کشورها، به نظر می رسد هرچقدر قدرت سازمان های بین المللی مدافع حقوق بشر و بشردوستانه ای همچون سازمان ملل در رویه عملی و تئوری شان افزایش یابد، به همان میزان از حاکمیت کشورها و مطلقه بودن آن در سطح داخلی نسبت به استاندارهای رفتاری بین المللی، کاهش می یابد. در این مقاله پژوهشگر به این سوال پاسخ می دهد که آیا شورای امنیت می تواند در مقوله محیط زیست نیز، اقدام به مداخله بشردوستانه نماید و صلح و امنیت بین المللی را در خطر ببیند؟ همچنین با مرور مطالب مرتبط و گردآوری اطلاعات از منابع مختلف، محقق به این نتیجه رسیده است که شورای امنیت وجود هرگونه تهدید علیه صلح، نقض صلح یا عمل تجاوز را احراز و توصیه هایی خواهد نمود یا تصمیم خواهد گرفت که برای حفظ یا اعاده صلح و امنیت بین المللی به چه اقداماتی طبق مواد 41 و 42 باید مبادرت شود. با احراز تهدید علیه صلح، نقض صلح یا عمل تجاوز مصرح در ماده 39، شورای امنیت می تواند بر اساس ماده 41 به وضع تحریم های گسترده از جمله اقتصادی و تسلیحاتی بپردازد و یا بر اساس ماده 42 به اقدامات نظامی متوسل شود. از آنجا که تشخیص و احراز وقوع تهدید صلح، نقض صلح و یا عمل تجاوز مذکور در ماده 39 منشور به خود شورای امنیت واگذار شده است. بر اساس این ماده، شورای امنیت این اختیار را دارد که وجود هرگونه تهدید علیه صلح و امنیت بین المللی را احراز و از طرفین دعوا بخواهد از اقدامات موقتی که شورا به صلاحدید خود اعمال می دارد، پیروی نمایند و از اعضای سازمان ملل بخواهد اقدامات لازم را برای حفظ صلح و امنیت بین المللی اتخاذ نماید.

    After World War II, fundamental developments occurred in international law. At that time, many treaties were adopted by League of Nations, some of which were human rights treaties. These treaties are very valuable as one of the sources of international law. The supportive nature of these treaties creates the possibility of analysis issues such as the right of reservation in a different way. The CEDAW (1979) is the most important treaty on women`s status and has the highest number of reservations among human rights treaties. Many of these reservations relate to the substantive provisions of the treaty, which has two main characteristics: generality, and being contrary to the purpose and object of the treaty. The purpose of CEDAW is indicated in its preamble. It calls for equality of women and men and also stipulates many specific areas where discrimination against women should be eliminated. Therefore, it is important to analyze these reservations. At first, the study examined how the treaty is ratified, it then defined the right to make reservation and finally it analyzed some reservations made by the Islamic and European states.

    Race and ethnicity establish the basis of Israel's political ideology. Their use of Jewish religion as a tool has provided the religious and ethnic racism for the Zionist regime. The Zionist regime has considered itself the only Jewish state in the world and has tried to set up a single identity on all its social and political gaps. The thinking has led to disunity in the international arena. It can be claimed that the roots of conflict in recent years are related to racism in Israel in the Middle East and other regions. The research attempts to answer the question of what is the root of racism in the the Zionist regime? In response to this question, this hypothesis will be tested. The racist ideology of the Zionist regime is based on the distortion of the Jewish and its attempts to dominate other nations.

    Women workers as one of the most protected social groups can be exposed to various harmful. For this reason, specific support has been provided to them in various international documents, including Human rights treaties and the International Labor Organization. Equality between women and men worker is a fundamental principle that must be respected in all legal systems. In domestic law, labor law, constitution and documents have recognized suitable support for women workers. One of the new issues of the International Labor Organization is the concept of “decent work” . Decent work involves opportunities for work that are productive and deliver a fair income, security in the workplace and social protection for families and …. The ILO pursues the plans and objectives of decent work in different countries. India is one of those countries that will implement a comprehensive program for decent work. In this article, we compare the status of supporting women workers in the rights of India and Iran in terms of decent work.

    The aim of the study is to investigate the condition of the existing international system and some of the legal dimensions of the humanitarian intervention based on the jurisdiction of states on their natural resources and especially the case of environment and the theories of the diminishing sovereignty of states. It seems that an increase in the power of international organizations and human rights and humanitarian organizations such as United Nations in the practical and theoretical terms, results in the reduction of the absolute and the national level sovereignty of states compared to international behavioral standards. Research question asks whether the Security Council can have humanitarian intervention in the case of environment and consider it a threat to the international peace and security. Through the review of related literature and the collection of information from different sources the researcher concluded that the Security Council will obtain any threat to the peace or its violation and will have some recommendations or will decide to take some actions for the securing or reestablishment of peace and international security based on articles 41 and 42. In fact in the case of the existence of a threat to peace or its violation, based on article 39, the security council based on article 41 can authorize comprehensive economic and weaponry sanctions or based on article 42 resort to military actions. In other words, the actions of the council for the protection of peace and against violations is not considered as intervention. Based on the fact that there are no official references for the evaluation and control of the decisions of the security council, the realization and obtaining the occurrence of a threat to peace or its violation based on article 39 of the Charter is considered the duty of Security Council. Based on article 39 of the Charter, the Security Council has the right to obtain the existence of any threat to peace and international security and ask the parties of the conflict to follow the transitional actions of the council through its own discretion and ask the members of the UN to take necessary actions for the maintenance of international peace and security.
