    یکی از واجبات مناسک حج و عمره، احرام است. احرام دارای واجبات و مستحباتی است. هرچند مشهور فقها از زمان سید مرتضی= تاکنون غسل را یکی از مستحبات احرام دانسته اند، اما با بررسی دقیق اقوال فقها در این موضوع، روشن می شود که قول مشهور قدما، وجوب غسل احرام است. بررسی ادله طرفین نیز نظریه وجوب غسل احرام را اثبات می کند. البته مخالفت با شهرت عظیم متاخرین مبنی بر استحباب غسل احرام، مشکل است؛ منتها پرواضح است که مخالفت با نصوص و نظریه اکثر قدما، مشکل تر از آن خواهد بود. بنابراین، راه نجات در احتیاط است.

    تحقیق حاضر به بررسی فقهی- حدیثی اعمال مسجد کوفه و سهله پرداخته و نحوه انجام دادن اعمال عبادی را در این دو مسجد شریف، به معنای دخیل بودن مکانی خاص از مسجد در صحت یا کمال عمل، بازپژوهی کرده است. تتبع در روایات مربوط به این دو مسجد نشان می دهد در خصوص مکان های معینی از مسجد کوفه، اعمال و ادعیه ای با نص صحیح یا معتبر وارد شده که بیانگر توجه و اهمیت عبادت در آن مکان نزد امام معصوم بوده و ارشاد به این مطلب است که انجام دادن عبادت در این مواضع، در کمال عمل عبادی و بهره مندی از ثواب تام، نقش دارد. اما در مورد قسمت های دیگر مسجد کوفه و تمامی مسجد سهله، دلیل روشنی بر خصوصیت داشتن موضعی از آنها یافت نشد. همچنین، انجام دادن عبادت در مکان های منسوب به انبیا و امامان معصوم: در هر دو مسجد شریف، به دو شرط یقینی بودن انتساب و اثبات عبادت مکرر معصوم در آن محل، در کمال عمل دخیل است و اقتدا به سیره عملی معصومین: محسوب می شود. اما در صورت اثبات نشدن عبادت مکرر معصومین: در آن محل و با فرض یقینی بودن انتساب، عبادت کردن در خصوص آن موضع، تنها از باب تبرک جستن به آن مکان، توجیه پذیر است.

    فقه اسلامی با تقسیم اراضی، از جهت ملکیت، به اقسام چهارگانه و جعل احکام متناسب با هر یک از این اقسام، نظام حقوقی و اقتصادی کاملی را در مورد اراضی جعل کرده است. این مقاله پس از بیان انواع اراضی به حسب ملکیت، ادله اقوال مختلف در تعیین نوع زمین مکه و مشاعر حج را بررسی کرده و با تعیین نوع این اراضی به بیان آثار مترتب بر آن پرداخته است. نتیجه تحقیق نیز این است که شهر مکه، عنوه فتح شده است؛ بنابراین زمین هایی از حرم و شهر کنونی مکه که در زمان فتح، آباد بوده ملک همه مسلمانان است و باید ثمرات و عوائد آن برای مصالح عموم مسلمانان صرف شود و اختصاص دادن آن به گروهی خاص، و تملک و خرید و فروش آن جایز نیست. اراضی مشاعر حج، جزء اراضی مشترک و منفک از ملکیت است. حق ارتفاق از این اراضی برای همه مسلمانان ثابت است و احیا و تملک و فروش و اجاره دادن این اراضی جایز نیست.

    نماز گزاردن به صورت دایره ای پیرامون کعبه معظمه یا همان نماز استداره ای در جماعت، از مسائلی است که مشروعیت و عدم مشروعیت آن از منظر فقه مذاهب اسلامی چندان هویدا نیست؛ زیرا تحقیقی موسع و یکپارچه در این باره صورت نگرفته است. ازاین رو پرسش از حکم نماز استداره ای در مسجدالحرام از منظر فقه اسلامی، مسئله ای است که نیازمند کاویدن تا مرحله پاسخی درخور است. سیره مسلمانان و عدم ردع حضرات معصومین: با رعایت شرایط ملحوظ در نماز جماعت، از جمله دلائلی است که به این کیفیت از نماز جماعت پیرامون کعبه معظمه مشروعیت می بخشد. این تحقیق با هدف شناخت اقوال و انظار فقهای مذاهب اسلامی و حدود و ثغور ادله و تبیین وظیفه و تکلیف مسلمانان در نماز استداره ای در جماعت انجام شده و نیل به این مقصد در سایه توصیف و تحلیل گزاره های فقه مذاهب اسلامی با گرد آوری داده های کتابخانه میسر است که نتیجه آن، مشروعیت نماز جماعت حول کعبه معظمه با یک امام جماعت و به صورت دایره وار خواهد بود.

    تامل در شیوه شارع مقدس در تشریع احکام شرعی فرعی به طور عام و در تشریع مناسک حج و عمره به طور خاص، حاکی از این است که امر قانونگذاری در شریعت اسلام، بر اساس سهل گیری بر مکلفان است و شارع در تشریع احکام، سمحه بودن قوانین را مدنظر قرار داده است. به عبارت دیگر، شارع به دنبال جعل قوانین، آن هم به گونه ای است که مکلفان به سهولت از انجام آن برآیند. شناخت روش شارع در تشریع احکام شرعی، به ویژه در تقنین قوانین حج، از این جهت اهمیت دارد که می تواند ما را به قاعده ای کلی در فقه، به نام «قاعده تسهیل»، رهنمون باشد؛ قاعده ای که صدور فتوا بر اساس آن، به روشنی در آثار فقها دیده می شود و سیره عملی بسیاری از آنان در اجتهاد، بر آن استوار شده است. بر این اساس، فقیه می تواند با استناد به این قاعده در فرایند استنباط، حکمی را وظیفه فعلی مکلفان قرار دهد که انجامش برای آنان به آسانی ممکن باشد. همچنین صدور فتاوای مستند به این قاعده، به خصوص در باب حج، را جایگزین صدور فتوا بر احتیاط هایی نماید که ممکن است در برخی از موارد، موجب سختی و مشقت بر مقلدین گردد.

    بررسی دیدگاه اندیشمندان برجسته مذاهب اسلامی در مورد شفاعت از آن جهت مهم و قابل توجه است که علی رغم این ادعا که گفته می شود همه اندیشمندان و پیروان مذاهب اسلامی به اصل شفاعت پیامبر (ص) باور دارند، ولی درباره معنای شفاعت و شرایط و آثار آن اختلاف نظرهای جدی وجود دارد. معتزله شفاعت را به معنای واسطه قرار دادن دیگری برای طلب منفعت و پاداش بیشتر نیکوکاران (اهل ایمان) در قیامت می دانند و مرتکبین گناه کبیره را مستحق شفاعت نمی دانند. ولی دیگر اندیشمندان مذاهب اسلامی، آن را وسیله نجات و رفع عذاب از گنهکاران تفسیر می کنند. شیعه و اشاعره شفاعت را مخصوص مرتکبین گناه کبیره می دانند. وهابیت نیز، هر چند که اصل شفاعت پیامبر (ص) در روز قیامت را قبول دارند، طلب شفاعت از شافعان به صورت مستقیم، و همچنین طلب شفاعت از انبیا و اولیا را پس از مرگشان، جایز نمی دانند. مقاله حاضر ضمن تبیین دیدگاه اندیشمندان مذاهب اسلامی در باب شفاعت، موارد اختلاف اندیشمندان مذاهب عمده اسلامی را مورد اشاره قرار می دهد و سپس به نقد دیدگاه وهابیت می پردازد و نشان می دهد که دیدگاه آنان مخالف آموزه های روشن قرآن و سنت، و مغایر با دیدگاه دیگر مذاهب اسلامی است.

    Ihram is one of the obligatory rites of Hajj pilgrimage and lesser pilgrimage. It has obligatory and recommended acts. Even though most famous jurists, since the era of Sayyid Murtada, have considered the Ihram ritual bathing as one of the recommended aspects of Ihram, but with accurate research on the saying of the jurists on this topic, it becomes obvious that Ihram ritual bathing is obligatory based on the sayings of the earlier jurists. Likewise, by studying the proof of the two parties, it is also established that Ihram ritual bathing is compulsory. Of course, objecting the tremendous stand of the recent scholars which says that Ihram ritual bathing is a recommended act difficult, but it is very obvious that objecting the text and the view of many earlier jurists shall be more problematic. Therefore the only way out is to observe precaution.

    The present research is investigating the jurisprudence and hadith the ritual practices at Kufah and Sahlah Mosques from jurisprudence and hadith aspects and how to observe worship at those holy Mosques by means of involving special places in the Mosque for correctness or perfection of an act. By exploring the narrations concerning these two Mosques, we find indications that there are special places at Kufah Mosque wherein there are rites and supplications to be performed as reported in authentic and reliable sources that show giving especial importance to worshiping at those places by the infallible Imams and indicate that performing worshiping rites at those places plays a role in perfection of worship and benefiting from complete reward. As for other sections of Kufah Mosque and the entire Sahlah Mosque, no obvious proof was found for any especial place. Likewise, as for performing worship at places attributed to the Prophets and the infallible Imams at the two mosques, certainty of its attribution and establishing the repetition of worship by the infallible at those places are involved in the perfection of activity and are considered as following the practical way of life of the infallible. But if the repetition of worship by the infallible is not established at those places even though there is certainty in its attribution to them, worship at those places is justifiable just as a form of seeking blessing from those places.

    By classifying lands in terms of Ownership, Islamic jurisprudence has divided them into four groups and specified appropriate laws for each, making a complete legal and economic system concerning lands. In this article, after explaining different types of land on the basis of ownership, we study the proofs of different views to determine type of land in Mecca and stations in pilgrimage and determine the type of those lands by expounding the effects thereof.
    The finding of the research is that the city of Mecca was forcibly conquered, thus the lands in the Haram and the present Mecca city that was developed are the property of the entire Muslims and the profits therein must be spent for the benefits of all Muslims; therefore, specifying them to a particular group, owning, buying and selling them are not permissible. The lands at pilgrimage stations are part of jointly owned lands and not subject to personal ownership. Therefore, the right to share these lands is certain for the entire Muslims, whereas reviving, owning, selling and renting them out is not permitted

    Praying in a cycling form round the great Ka’bah or cycling prayer in congregation is among the issues whose legitimacy or illegitimacy is not obvious from Jurisprudential perspective, since an extensive and unified research has not taken place in this respect. Therefore, the question on the law of cycling prayer at the sacred mosque (Masjid al-Haram) based on the Islamic Jurisprudence is an issue that needs to be analyzed to get an appropriate answer. Indeed, the way of life of the Muslims and not being rejected by the holy infallibles and by observing the conditions of congregational prayer are among the proofs of legitimacy of praying in congregation round the great Ka’bah. This research is aimed at knowing the sayings and views of the Jurists of Islamic denominations as well as the limits and the proof by expounding the duty and responsibility of the Muslims during cycling prayer in congregation. Achieving this goal in the light of description and analysis of jurisprudential propositions of Islamic creeds is achievable through gathering data from the library sources. The result will be legitimacy of congregational prayer round the great Ka’bah with one congregational Imam and in a cycling form.

    Pondering over the method of the holy legislator in enacting Islamic subsidiary laws in general and that of Hajj rituals and lesser pilgrimage in particular indicates that the lawmaker in Islamic law made the laws based on simplicity upon religiously accountable persons and the holy lawmaker has taken simplicity into consideration when enacting the laws. In other words, the holy lawmaker has made laws in a way that it will be simple for religiously accountable persons to implement them. Knowing the method of enacting the laws by the holy lawmaker, especially the laws of pilgrimage, is so important as it guides us towards the general rule in jurisprudence known as “rule of simplification”; the rule issuing decrees based on which is clearly seen in the books of the Jurists and their practical way of life in deducing religious laws. Accordingly, by citing this rule, a jurist is able to deduce a law for the religiously accountable persons in such a way that it will be simple for them to implement. Likewise, through this rule, he is able to issue his decrees particularly in the chapter on pilgrimage as alternative the decrees issued based on precaution that can be difficult for his followers in some cases.

    Studying the view of the prominent intellectuals of the Islamic denominations concerning intercession is important since despite the fact that the entire intellectuals and the followers of the Islamic denominations believe in the intercession of the holy Prophet, they have serious disagreements concerning the meaning, conditions and the effects of intercession. The Mu’tazilite believe that intercession means seeking intermediary help from others to get benefit and more rewards for the benefactors (the believer) in the Day of Judgment and it will not involve those that have committed great sins. But other intellectuals of Islamic denominations have explained that to be means of rescue and taking away punishment from those who have committed sin. The Shia and Asha’irah believe that intercession is specifically for those who have committed great sins. The Wahhabis, even though they accept the intercession of the holy Prophet in the Day of Judgment, regard seeking intercession from intercessors in a direct form and, likewise, seeking intercession from the Prophets and the friends of God after their death as not permitted. This present article, while explaining the views of the intellectuals of Islamic denominations concerning intercession, refers to the areas of disagreement and then criticizes the Wahhabis’ view to show that their view is inconsistent with the teachings of the holy Qur’an, the tradition of the holy Prophet and the perspective of other Islamic denominations.
