Abstract:
Articles 1121 to 1128 of civil law deals with impotency, which is a valid reason for abrogation of marriage contract. Jurisprudential review of the present article expresses its religious teaching which has now become a law. It touches upon some impotencies common between wives and husbands. The defects of either side are valid reasons for divorce and declaring the marriage contract null and void. Some of them are specified only for men and others only for women. Questions arise on the following grounds: Are the impotencies recognized by civil law exclusive? Are there other impotencies permitting abrogation of marriage contract? Is there any special criterion for it? Are all the provisions applicable in the present society? This article attempts to answer the above mentioned questions. As Iranian laws are based on jurisprudence; therefore, by reviewing these references legal changes can be possible. The study indicates that laws related to impotency which might be a ground for marriage dissolution can also be modified.
