The Nature of " Mezaqe Shari at" [Taste of Shari a] and its Jurisprudential Pathology

Abstract:
In this article, to criticize the jurisprudential reasoning called “mezaqe shari’at”, first its background has been introduced and then works by mezaq-oriented jurisprudents have been investigated and the meaning they intend by mezaq was obtained. Then, on one hand, reasons against orientation toward mezaq were mentioned and on the other hand, making a system out of discrete documents has been introduced as an acceptable alternative for orientation toward mezaq.
