Surveying women's inheritance in the laws and customs of Iran and India

Abstract:
In this paper the inheritance of women is discussed in the laws and customs of Iran and India، by descriptive-analytic method and library data in a comparative way. In Islamic point of view، The women’s inheritance is her own absolute property and she is not even obligated to spend it for her family’s life costs. In India also، women and men are equal in receiving inheritance. While in both countries، in some cases، the customs prevent women to reach to their rights، this problem is more obvious in India. Since Islam is a complete religion and its globalization depends on eliminating the ambiguities، a comparative surveying of an Islamic country like Iran and other societies is necessary. The main point in this paper is about women’s financial benefits in inheritance، considering Islamic Iranian and Indian legal rules. In which system women receive more financial benefits? In this paper it is hypothesized that women''s financial benefits in Iranian juridical system are more than India.
