The Possibility of Inheriting the Deceased's Body Organs

Abstract:
One of the cases where applying the inheritance rules، seems to be questionable is the inheritance of the deceased’s body organs. Despite the great significance of this issue، it has not been examined properly. This paper deals with the possibility or impossibility of inheritance of body organs by the heir/s. Part of this paper is on the domination and authority of a man over his body organs and the other part discusses the marketability of the body organs and whether they can be classified as part of the estate. It is concluded that the heir/s to the deceased has/have no authority or right with respect to the organs of the deceased. Although it is possible to prove the marketability of body organs they cannot be inherited. The only property that can be inherited is the property owned by the deceased when he was alive and therefore his estate does not include his body organs. The heirs can inherit the blood money (diah) for the manslaughter of the deceased (and for his murder in certain cases) or for the injuries inflicted on the deceased’s body but inheritability of the deceased’s body organs themselves is still questionable.
