Independency and Dependency of the Peace Agreement in Jurisprudence and Law

One of discussions between jurists and lawyers would be whether the Peace Agreement، despite it is included in Agreements (i. e. ‘Uqud)، is an independent agreement or a subagreement dependently and belongs to other agreements. With such an explanation، is it a branch of Bai’ and has it Bai’s rules and ingredients in transactions? And has it the results of Rental Agreement and is it branch of Rental Agreement in situation of renting? Most of Shiite jurists know it as an independent agreement and it is known as a main and independent agreement in law of Iran too. In contrast، Sunni jurists do not count the Peace as an agreement independently but a branch of agreements which the results of that resemble them. This article tries to analyze the topic and scrutinize it in a comparative manner.
