Criminal responsibility of public officials in the use of prohibited weapons (Take on the procedures of the international criminal courts)

Context and Some international lawyers believe that if severe international crimes and to combat impunity for such crimes, important government officials should not enjoy immunity from prosecution.

Findings: The main objectives of this study was to amend the provisions of existing conventions, in order to avoid the use of banned weapons in future wars, and strengthening global consensus and international organizations and strategies is required or criminal liability.
in an overall assessment, a glance at the developments of Criminal responsibility of public officials from Versailles Treaty up to now which has been brought in the constitutions of tribunals for Nuremberg(article 7), Tokyo (article 6), former Yugoslavia (articl 7), Tribunal for Rwanda (article 6), Special court for Sierra Leone (article 6) and the procedures of the international and national criminal courts suggests that at the present, government officials are not safeguarded from nor personal and nor occupational immunity concerning use of prohibited weapons. In other words, those, especially government officials, who benefit from immunity cannot rely on their own immunities in case they violate peremptory international laws and to be cleared from criminal responsibility
