The jurisprudential study of insulting the anti-religion by the Muslims

Abstract:

Offending and insulting the beliefs of the follower of a religion, in addition to cultural downfall, causes the emergence of widespread crises and divisions which endangers the political and social life of the nations. Therefore, the present paper jurisprudentially studies the issue of insulting the anti-religion by the Muslims. By exploring the jurisprudential sources, it can be found that if the non-believers insult each other, the Muslim ruler will not punish them if this insult does not have any harm to the Islamic society and does not cause sedition, since according to Islam the non-Muslims deserve offense and abasement. The insult of the non-Muslims by Muslims is also permitted according to the jurisprudential measures and the initial titles of the edicts. The present paper after explaining the evidences of legitimacy and illegitimacy of insulting the non-Muslims by Muslims, proves that insulting the unbelievers is prohibited, blamed and far from the Qur'anic manner and the tradition of the Infallibles, in all parts of the life especially in religious propagation.
