The Theory of Depecage in choice of law Analysis

Abstract:
The determination of governing law is one of the significant issues in law cases specially those pertaining to international law. The governing law has an important role in determination of the partie's rights and obligations. With this in mind, the question that has yet to be answered is the ability to apply different governing laws in one unique legal case.
The application of the theory of Dépeçage which is the application of different laws to different legal issues in a legal disputes may help to resolve this issue. Expressly, Dépeçage is a choice of law on an issue-by-issue basis. In other words, this theory refers to the act of cutting up a case into individual portions where each issue is constrained by a different applicable choice of laws analysis.
One of the advantages of the application of Dépeçage is maintaining partie's interests which will have a positive results on increasing foreign investments. Moreover, this theory could help to solve complex international law problems as well as granting more justice through emphasizing on the most related law to the given issue.
