The review of Conspiracy offense in the criminal law of Iran and the U.S.A

Abstract:
Conspiracy to commit a crime has always been a concern to lawyers for the sake of similarity between material and mens rea element of crime; because, for some, the only crime which is the criminal mind of a crime is criminal collusion. Accordingly, in Iran and the U.S.A law, collusion meaning the agreement between two or more to commit a crime, has been criminalized in two fields of crimes against security and other crimes. In this research while inspecting the legal provisions and a comparative approach between the two legal regimes of Iran and the U.S.A, it is tried to study the similarities and differences of constituent elements of the crime, distinctions of collusion from other similar titles, profile proceedings, strengths and weaknesses of these two regimes in relation to the mentioned crime. It seems despite the similarities in the legislative field, these two regimes are different in some cases such as evident acts, lapse of time, type of punishment and etc.
