Contemplate on the Legitimacy of Targeted Killing Tactics under International Humanitarian Law

Abstract:
"Targeted Killing" tactic is a new concept found its way into realms of Human Rights Law (hereinafter HRL) and International Humanitarian Law (hereinafter IHL) literature by Israel in recent years, supported by western countries and United States of America aimed at casting the implementation of HRL and IHL-related treaties into doubt. Targeted killings as a new strategy in the fight against terrorism, have raised numerous uncertainty in the view of IHL. The present paper, through proposing the existing ambiguities as to the related tactic, aims to assessment the legality of resorting to it by some countries including the United States of America and the Israeli regime, under the basic principles of international humanitarian law, such as the principle of Distinction, Proportionality, and Necessity. In this assessment it is shown that, targeted killing politics in most cases violated these basic principles and has not been provided, a documented and acceptable legal logic for resorting to this new strategy.
