The Standards of the Terrorism Offence in the International Documents and the Law of Iran

The ultimate aim of this research is to study the standards of terrorism crimes in the international documents and the law of Iran. This note has examined this issue with applying the analytic- descriptive method with gathering objects from the library and internet sources. In spite of having been expanded and grew the specifics of terrorism phenomenon, it is only some decades that it has been turned to a controversial and international and domestic (national) issue. Despite all countries convicting terrorism today, unfortunately, the terrorism debate has changed more to political aspect than a legal one. It has not been considered an independent offensive title by Iran criminal law. The crime of Baghi, or armed rebellion or uprising against the legitimate ruler is not an exception of this principle. Some law scholars believe that Baghi, or armed rebellion is a political crime. But one of the most important crimes against the community security which faces with a severe criminal reaction in Islam is disturbing peace and order in the land- fassad fil-arz and muharebeh (fighting against Islam). Over the history, Iran especially after Iran's Islamic Revolution has been targeted by a lot of terrorist crimes but Iran's laws have never observed to face this evil phenomenon severely. With considering that, it has been codified 13 international documents to combat terrorism, Iran has only ratified 6 documents of these 13 documents. Islamic Republic of Iran should ratify a comprehensive law about this evil phenomenon which leads to genocide. Perhaps, one of the reasons that Iran is as the first and the largest victims of terrorism is lack of this comprehensive law about terrorism.
