Penological Analysis of the Death Penalty in the Anti Drug laws

Abstract:
There has been the death penalty for drug offenses in Iran legal system for many years and applied for convicts. This penalty have been predicted in numerous cases in the Anti Drug laws passed in Convenient Council in 1988 and its modified version in 1997 and 2010. Considering the execution of a large number of drug offenders and incidence of drug-related offenses, during the years that the law has been implemented, a question arises: Has the death penalty achieved the goals of punishments and public prevention, in particular? Social realities and official statistics that have been presented, show that success of the death penalty in Anti Drug laws is doubtful in achieving the goals of punishment. In this study, with the analytical view, the death penalty in Anti Drug laws has been investigated from the perspective of penological and failure of death penalty in fulfilling the goals of punishment has been proven. Also inappropriateness of death penalty with some criminal behaviors in the law and violation of principles of punishments has been proven.
