The Air Passenger's Rights with Emphasis on the EU Procedure (Modified Regulation No.261, Approved in 2004)

However, EU regulation has been one of the most successful areas of EU actions in the field of consumer protection, the application of Regulation 261/2004 in practice has led to persistent compliance problems across member states and legality of the measures has repeatedly been at stake, as airlines challenge the validity and interpretion of the regulation. On 13 March 2013 the European Commission finally heeded these complaints, set of proposals for a regulation 261 to amended, and extended existing regime of passenger rights protection. This article takes an analysis of these reform proposals in light of the case law of the CJEU and national courts .The commission's reform proposals should thus be accepted as the starting point for dialogue about passenger rights and paving the way towards a passenger rights.
