A Critique on the Arguments of Executing Option of Condition in Marriage

One of the important issues of the family jurisprudence in the jurisprudential school of Islam is the possibility or impossibility of inclusion of option of condition in marriage; an issue that has been examined in most of the main books of jurisprudence, although
various arguments have been mentioned to disprove it. It should be said that these evidences are preferential, criticizable, and rejectable. Meanwhile, only the Muslims’ consensus and practical sīra can be relied on; however, this consensus and sīra is to be studied in light of general intellectuals’ stipulation. This article undertakes to study, critique, and analyze the arguments for the rejection of option of condition in marriage and has taken a step toward expurgation of the discourse and purifying it from not-much-accurate statements.
