Researching of the Statute of Condition of Option in Marriage

Article 1069 of the Iranian civil code has voided the condition of option in contract of marriage but it is silent about the effect of void of condition on contract while in the imami jurisprudence further than void of condition of option in marriage, the famous opinion is void of this condition. However the question is that if void of condition of option in marriage is based on the strong reasons and if the mentioned condition must be from the merely void condition or the void of marriage contract is necessary too? Moreover if the void of condition of option is appertained to perpetual marriage or there is in the temporary marriage? This search with descriptive method has researched the subject from the juridical and legal viewpoint and with the critic and study of different reasons has received to this conclusion that at all from the viewpoint of jurisprudence, the stronger opinion is void of marriage contract in perpetual marriage (no in temporary marriage) and the silence of the lawyer about the void of contract of marriage carried on acceptation of validity of contract. But non dissociation between the perpetual and temporary contract in the field of void of condition of option is critical and better to amendment.
