EXPLANATION OF DIFFERENCES BETWEEN OPINIONS OF ALLAMA NAEENI AND IMAM KHOMEINI ON VILAYAT-E FAQIH DOCTRINE BASED UPON INTERPRETIVE THEORY OF ERIC HIRSCH

Abstract:
The difference in the views of scholars on "Vilayat-e Faqih and its boundaries" has been of the main legal disputes in recent century. It seems that the classic interpretation theories and approaches of the West have recognizable capacities to explain the causes of the formation of the differences from a new perspective. This article seeks to explore the different views of Naeeni and late Imam Khomeini, the Supreme Leader, in the field of Vilayat-e Faqih with the help of the achievements of the theory of "interpretation" expressed by Eric Hirsch, later thinker of classic hermeneutics. The present study, unveiling explicit assumptions of the two jurists using qualitative content analysis of the texts and narrations stated in Vilayat-e Faqih doctrine found that the main reason of their differences has been laid on their different perception from "semantic horizon" as a key concept in the theory of Hirsch.
