Criticizing the Iranian Criminal Legislator's Attitude Concerning how Criminal Conduct is Supposed to be Attributed to Legal Entities

Abstract:
Regarding the criminal liability “legal persons” in the Iranian criminal legal system, there have been some changes according to the social, political, economic and cultural realities, which have turned legislators’ attention and thoughts to criminalization of legal entities’ conduct. Traditionally, crimes consist of three elements: legal, psychological and material that are essential to be realized and proved for the criminal liability of legal persons. The current study states the fact that the crimes committed by these persons in the Iranian criminal justice system are totally dependent on the deeds of their managers and administrators. Hence, the crimes committed by legal entities can be considered as a function of criminal behavior of real persons.
