Study of the Impact of the Illegitimate Aspect in the Soundness and Corruption of Transactions

Abstract:

One of the important jurisprudential and legal issues concerning transactions is discussing the impact of illegitimate aspect in the soundness or invalidity of transaction. The illegitimate aspect is the ultimate cause of an interaction resulting in right of people or right of God. It is attempted in this writing to present a universal outline of the illegitimate aspects that comprising its various referents by distinguishing between various types of illegitimate aspects as well as paying attention to the intentional and unintentional topics in transactions, and to specify the status of various types of transactions having an illegitimate aspect. It seems that in transactions having an illegitimate aspect only the transactions that merely violate right of people are valid and other transactions are invalid due to the verity of the topic “assistance in sins and enmity” as well as the impediment of “ What happened was not intended and what intended did not happen”.
