Intention as a circumstance in Electronic agreements in Feqh

One of the circumstances of correctness of agreements is the serious intention to do it with the clear expression on the part of both parties. This circumstance comes from obtaining the wisdom and maturity of both parties through available evidence and according to reasonable elements. But to prove and obtain this circumstance is difficult in electronic agreements and faces many questions such as : With due attention to unawareness of one partner about the contraction of an agreement by the other partner not being face to face how is it possible to prove the intention of transactions? Does basically the necessity of intention includes the electronic agreements too?And if it's so, how can we obtain it?And how should each one of the parties express it? And how much valid are the electronical advertisements? There are all these questions while the studies in Feqh about the intention in such agreements are less concerned in available articles.The article is able to prove the necessity of intention and realizing it in e.agreements according to Islamic Feqh and common analysis. Then after presenting the way of obtaining the intention beside the study of the necessity of clearness in contraction and expression of intention it is able to show the importance of Feqh in electronic advertisements and calls
