Ruling over construction a joint building in Mena for the view point of Islamic denominations

Abstract:
Mena is a land where many major Hajj rituals are done. Due to the increasing number of pilgrims who would like to practice the Mena-specific rituals there and not being a vast land, huge crowd gather there and cause many problems for pilgrims (Hajji). But, can we construct a joint in this land to solve the problem? Is such a construction permissible? The Saudi Arabian council of senior scholars, resorting to the clues such as preventing any corruptive deeds and Al-Sirah (prophetic biography) as well as a narration from Ayesha, has declared the construction of any building even a joint one in this land prohibited. Yet, the analysis of the clues shows that none of these clues can prove the prohibition of the joint building construction in Mena. In return, the nature of continuity of presumption of innocence as well as generalities of principle of the right to possess things the permissibility or prohibition of which is doubted, generality of easement right, the fixed tradition of Muslims since the time of the Messenger of Allah (PBUH) and a narration from Imam Kazim (as.) are strong reasons for permissibility of constructing a joint building in the land of Mena.
