Rules and Conditions of Inheritance in Imamiya Jurisprudence and Iran Law with Emphasis on Imam Khomeini’s Viewpoints

An issue that has drawn lesser attention in the field of inheritance is that beside properties, rights (and its different types) too can be a subject of inheritance. However, there are differences among different types of rights. Imam Khomeini maintained that these differences can influence the inheritability of a right or otherwise. The main question of this paper is: What rights are inherited and what are the principles for inheritability of a right? Descriptive and documental methods have been employed in this research to find out a general rule for inheritability of rights based on the viewpoints of the jurisprudents, jurists and Imam Khomeini. The findings of the research indicate that among different types of rights, only financial rights are inheritable, unless in some special cases that non-financial rights too are inheritable.
