In these fields, various and different views have been presented in jurisprudence and law. The legislator's statement also has inconsistencies. From a legal point of view, the rule of the necessity of taking an oath in a lawsuit against the deceased includes objective lawsuits and can be extended to lawsuits against absentee, minor and insane, and it also includes the Claimant's heirs claim against the deceased, and condition of the necessity of such an oath is doubting the survival of the right.
