The effect of the plan to require the official registration of real estate transactions on reducing the crime of forgery and fraud
Although the legislator considers transactions with ordinary documents to be valid and valid, but in the case of immovable property, this credit is subject to official registration procedures. Based on this, a plan was approved in the parliament in order to require the official registration of real estate transactions, which is still a point of contention between the parliament and the Guardian Council. One of the challenges associated with this is the increase in the crime of forgery and fraud in documents. Based on this, we examine what effect this plan has on reducing the crimes of forgery and fraud?
This research has been done in terms of practical purpose and in terms of collecting information by documentary method and by studying valid laws and sources and the obtained information has been analyzed descriptively-analytically.
The plan to require the official registration of real estate transactions was approved by the parliament on 10/13/1695 and on 2/31/2016. However, after the draft obligation was sent to the Guardian Council for approval, it encountered problems. Document registration, along with the importance, validity and probative power that it gives to the document, has functions such as moral and social health of the society
