The powers of the guardians of the tail in the murder with an approach to the views of Imam Khomeini, Khoei and the owner of the jewel and the relevant laws of Iran

The present study seeks to analyze the limits of the authority of the guardians in murder with an approach to the views of Imam Khomeini, Ayatollah Khoei, the owner of jewelry and relevant Iranian laws, with the aim of examining the jurisprudential opinions of this group of religious scholars in order to obtain funds. Their jurisprudential and ijtihad opinions have been shared and differentiated and they have been complied with the relevant Iranian laws. The research method of this research is based on library studies and descriptive and analytical. The sharing of the opinions of these jurists is related to the Qur'anic meanings and the citation of valid and beneficial narrations. It is their kind of look. The results of the study showed that the appointment of a guardian under the title of those who inherit the right of retribution, with the exception of the couple who are excluded from it due to the verses of the monarchy and consensus, and the lack of retribution for the father to kill the child and no inheritance پدرAcceptance of the father from his murder, preference of the theory of determining retribution in premeditated murder, conciliation of the guardian with the killer at least and most of the predestined diyat in premeditated murder, specification of the guarantee of diyat by some parents without the permission The heir agrees to specify the guarantee of blood money in quasi-premeditated murders and pure error, and to accept the guarantee of the wise in murder.
