Responsibility of the Judiciary Against the Parliament

Abstract:
The Separation of Powers is basically found in the Constitution of the Islamic Republic of Iran. Thus the rulling powers i.e. the Executive Powers, the Legislature and the Judiciary are separated from the others. Although the independence of the Judiciary systemhas got its own particular characteristics, to have authority over it, also leaving no other alternative for the impeachment, interpellation and deposition of the judiciary in charge, there may still be circumstances where some powers and duties of the legislature can impress upon the judiciary system. This impression is indicative of a kind of relativeauthority of the parliament. The responsibility of the Judiciary against the Parliament under the Constitution of Iran (principles 76 & 90) concerning duty of support and administration of public rights, keeping and extension of security and lawful freedom may be one of the appearances of such authority. Bearing in mind the objective ofsteadiness and power of religious democratic regime, the Judiciary shoud be respondent against the parliament and people in order to explain, stabilize and institutionalize the judicial justice.
