Explaining the Status of Development Planning in the Legal System of the Islamic Republic of Iran

Abstract:

Development law is a branche of law that facilitates human achievement of basic needs and is of interest to various nations. Achieving development requires planning that takes place in the form of a planning system. There are various models for achieving development through which governments exercise sovereignty and public authority, based on the ideology, ideals, principles and goals of society. Based on the constitution and other upstream instruments, governments plan for development according to a purposeful element. Using a descriptive-analytical method, this paper seeks to explain the legal status of development planning in the Iranian legal system and identifies different patterns of development and finally answers the question which development modell matches the legal system of the Islamic Republic of Iran? The findings of this study show that development planning in Iran is not consistent with current economic models and by explaining the legal system of development planning in Iran, an appropriate model will be proposed.
