A Review of National and Executive Effects of Theoretical Approaches and the Islamic Republic of Iran's Human Rights Doctrine

Abstract:
Theoretical approaches taken by the Islamic Republic of Iran which encompass totality of the country including the political system, the nation, civil society and independent institutions of Iran have progressed in a relatively smooth manner since the beginning of the Islamic revolution compared to the issue of human rights, but there have been variations when it comes to importance attached to any special category of human rights, especially inside the country. This can be a basis for identification and differentiation of five periods of time each having its own coordinates. This paper will discuss subjective criterion of human rights from two angles; namely, theoretical approach given priority by the Islamic Republic of Iran as well as common international theory about three spectra or generations of human rights. Though the effects of domestic policies on foreign policy are evident, the said prioritization has been lacking and enjoyed its own features some of which have been mentioned here. Another goal of this paper is to show that since the beginning of the Islamic revolution, the theoretical approach taken by Islamic Republic of Iran toward the human rights (especially with regard to government and political system) has been inspired by the Islamic sources or has been introduced as such, regardless of whether it has been presented in a suitable manner or not. Therefore, its positive or negative practical and executive aspects would have reverberated inside and outside the country as the deeds of Islam and especially in other countries, performance of other Muslim nations has been compared to theoretical and practical approach taken by Iran and has been ensued with specific judgments. Finally, despite repetition of some viewpoints that were taken from Islamic sources with respect to human rights and despite high potentials among intellectuals and scientific elites of Iran, the Islamic Republic of Iran has not yet presented the world with a comprehensive legal doctrine to cover various aspects and to answer all questions rife in the world. Therefore, pundits should try to find a solution to this problem.
