The Hierarchy of Legislation in the Islamic Administrative System with Emphasis on the Constitution of the Islamic Republic of Iran

Abstract:
Since during the occultation period the Islamic system has to be based on the theory of Welayat-e Faqih (guardianship of jurist) and the legitimacy of all its branches be authorized by wali-e faqih (legal guardian jurist), the political system of Islam can be regarded as a basis for the administrative system. If the administrative system continues to be in harmony and consistent with the political system of Islam, this correlation and connection will be invulnerable. The Islamic system was founded on this theory in Iran, and sometimes, due to disharmony and inconsistency between these two systems serious challenges and even crises will arise in the management of the affairs. The present paper expounds one of the mechanisms for maintaining such harmony, namely, "hierarchy of legislation in Islamic administrative system". The article makes use of the Quran commentary, certain Quranic verses, traditions, and the Constitution of Islamic Republic of Iran.
