Accessory Punishment in Emamit Jurisprudence

Lawyers based on different criteria, have provided different classifications for the punishments. On the base of relationship that exists between the penalties, punishments divided to the main punishments, complementary punishments and accessory punishments. This paper seeks to examine issue of accessory punishment in Emamit law. But at first the paper explained the concept of the accessory punishment then paper firstly challenged the position of the accessory punishment in the Islamic religious punishments and then compare the goals of the accessory punishments with religious punishments. With existing flexibility in the punishment of the Tazir, Accessory punishment argued of the form of this kind of punishment. In following tried to explain the legal basis for this penalty is provided in some of the religious texts and emphasized on the "rationality" as one sources of Islamic law. At the end of the paper common and specific examples of the accessory punishment mentioned such as "Deprivation of inheritance," "deprivation originated apostasy", "deprivation originated sexual crimes", including specific examples of Islamic accessory punishments. The "missing of justice character" is explained as common example of accessory punishment.
