The connection of human rights and humanitarian law in Islam, obstacle for refusing a West invasion

Abstract:
Human rights and international humanitarian law as a two distinct branch of public international law have a special subject of themselves. Although at final the object of this two branch is a support of human, but the connect of them come back to the "hard core" of rights, in the Islamic law this two legal branch is not taking apart and as a privilege of Islamic law to the public international law, human right even in the wars is self – executing, furthermore in Islamic law the regulation of human right and humanitarian law is applicable in the non international conflicts, whereas in international séance this movements defeat severely irrespective of many regulations for supporting of human. Contrast in many accusation about violation of human rights in Islam many of Islamic regulations are perfect and have a character of "Erga omnes" in compare with international well known principle, which this investigation was divided to this matter.
