Parties to a claim in international air transportation and competent court based on the Warsaw Convention and the amendments thereof

The air transportation system as a basic method in the domain of international communications and exchanges has an important role and position and due to its expedition it has a special significance particularly in passenger transportation sector. Due to the domination of its international aspect, this method of transportation is subject to the international rules more than other means of transportation to the extent the domestic air transportation of certain countries such as Iran follows the related conventions like the Warsaw Convention. One of the important issues in the legal discussion in this domain is the identification of the beneficiaries and holders of the right of filing petitions to demand compensation (plaintiff) on the one side and determination of this fact that against which respondents- the persons who have sustained losses and have the right of filing petition- may do so to demand compensation on the basis of the liabilities stipulated in the Warsaw Convention and the amendments thereof. Moreover, appointment of the competent courts to review these petitions is also an important issue in this respect. The present article discusses these three issues based on the 1929 Warsaw Convention, The Hague Protocol of 28 September 1955, Guadalajara Convention of 18 September 1961 and Guatemala Protocol of 8 March 1971.
