The Criminal sanction of the offences against human rights and humanitarian Law

From the early days of outbreak of first world war which came together with the annihilation of millions of humans followed by the second world war which are considered as the worst times of man's life, free people of the world, especially intellectuals of human societies, gathered in international associations to prevent from repetition of such disasters and specified possible minimums to guarantee man's safety, security. Freedom and generosity by codifying international regulations and conventions in the fields of human rights humanitarian rights so that these minimums may be addressed and respected by governments and rulers whether during war or peace. Meanwhile what is significantly important is the execution guaranty of these international regulations and conventions since however these regulations are good; they cannot guarantee the concerned goals of their legislators in case of non-execution. The issue of Sanction or Executive Guaranty is one of the most disputable and complex issues in international law which has always been addressed by scientists and religious authorities. Executive guaranty of legal regulations is usually hidden inside them and has its specific rules depending on the viewpoints and on the case which is either domestic or international. For humanitarian rights, sanction or executive guaranty has a double importance because the guaranty of man's safety, security, freedom and generosity is under consideration and has an international origin. What is certain is that in case violation of human rights and humanitarian rights find a criminal topic (in the manner expressed in various international conventions) it will need criminal executive guaranty. In this paper, we have dealt with criminal executive guaranties of crimes against mankind and humanitarian rights by considering the historical trend and international conventions.
