Controllers of government resolutions in the legal system of the Islamic Republic of Iran (With and emphasis on the controls based on the Constitution)

Abstract:
Any legal system with an efficient and expurgated legal hierarchy should think of clear and proper policies in order to guarantee its superior sovereignty. In the hierarchy of the legal sources, government decisions (resolutions, by-laws…) have weak status and in line with guaranteeing the sovereignty of law (Constitutional law and ordinary law) it is imperative that the resolutions should be compared and controlled in terms of non-discrepancy with their senior legal classifications.The present research attempts to draw a concise and clear portrait of the competent authority or reference that should exert such a control and supervision including religious control, Constitutional law and ordinary law. The main idea of the author is that the government resolutions should be controlled by the Administrative Court of Justice in terms of non-discrepancy with the Constitutional Law.
