An Analysis of Therapeutic Abortion Law of 1382

At different frames of time, most countries have had different approaches to the issue of abortion. Also after some years, in the Islamic Republic of Iran, with the ratification of a single article in 1384, therapeutic abortion was announced as permissible; but the above mentioned article lacks the necessary clarification and has some ambiguities that make its interpretation and even correction a must. Hence, in this article by pointing out the ambiguities of the above mentioned law such as the lack of the definition of titles and terms like deformed, haraj (constriction) and absence of the role of father's consent in performing the abortion by reviewing existing books, articles and documents in this field, the author has tried to open new windows to therapeutic abortion. In her opinion one of the cases that should be corrected is clarifying the goal of this article. It is suggestsed that if under legal condition the woman dose not consent to an abortion; the husband can oblige her to do so. Also the writer believes it is better that the phrase “mother’s illness” be removed from this article and the phrase “a threat to the mother’s life” be replaced with or added to it.
