Criminal maturity

Criminal maturity، meaning the recognition of goodness and evilness of deeds، is of utmost importance in judgement because if the need for establishment is proved، the person immature in this regard will not be punished، neither will his/her punishement be mitigated. This has not been clearly stated in the criminal code of the Islamic Republic of Iran which itself has been designed on the basis of Islamic Jurisprudence. Hence، some contemporary lawyers believe that the Act، particlularly its Article No. 49، needs reconsideration. The present author has tried to suggest an appropriate solution by carefully studying juristic texts، rereading the views of Islamic juristprudents، and considering the intellectual maturity needed for a person to be consdered criminally mature.
