Religious jurisprudence has been paid special attention the issue self-respect protection so that obligation and prohibition order have been emphasized in case of interference with self- life or else in many cases. However the jurists have not thought about, the issue of physician responsibility for emergency patients in particular. But the physician responsibility for emergency patients can be studied in two aspect in religious jurisprudence. Therefore, investigation of their view point requires a deep study. The results show that religious jurisprudence have mostly thought about the rescue of risky patients in many traditional examples. But regarding to relationship between duty and statute order; it can be said about the above mentioned assumptions are not property and the majority opinion of religious jurisprudence is on the necessity of this order in these conditions. Who is leaving it she or he will be held accountable. Although, there is dispute Between Sunni and Shiite religious jurisprudence about necessity of getting consent to begin treatment of emergency patients who their family are not available, but the majority Shiite religious jurisprudence have ordered on the necessity of this term.
