Security Council and Playing a Role in the Process of the Formation of Customary International Law

Similar to the UN General Assembly and other international bodies that identify practice and opinio juris of States, acts of Security Council can also play a role. In the view of some writers, this matter prima facie has been oversighted in the first report of Special Rapporteur of International Law Commission, Professor Michael Wood on formation and evidence of Customary International Law. In the scope of the formation of customary international law, in general, international organizations’ acts should be observed in two respects which in this framework, there is no difference between State-oriented organs of the organization. On the one hand, international organizations are one of the active subjects of international law and their acts have contributed with States’ practice to the process of theformation of customary rule and on the other hand, in every organization, States act and practice independently. Therefore, in the viewpoint of the latter observation, international organizations’ resolutions are appropriate potentials for evolution of States’ approach toward matters involved reflecting opinio juris of States. In this context, the practice of the Security Council as the most important UN State-oriented organ, undoubtedly is considered as the act of the organization and may contribute to the process of formation of Customary International Law.
