A Comparative Study of Conditions and Scope of Quotation from another Work (With Emphasis on the Iranian and French Law)

Protection of material rights require that any use of work is be considered impossible, if the copyright holder is not satisfied. However, in order to establish a balance between the exclusive rights of the author and the public interest, some used in "exception" is permitted. One of the exceptions, is Quotation from another work. This study is a comparative study of recent exception conditions and by implication the Iranian and French laws with descriptive and analytical….The results show that the quotation from another work permit is subject to compliance with the moral law in in French and Iranian law. The quantity of quotation to the prescribed the criteria. In addition, although quotation in French and Iranian law is not limited to a certain kind of literary and artistic works. the fulfillment of the requirements for application of the exception in the literary and scientific works are easier. However the artwork may not be easy to the fulfillment of these conditions.
