Recognition and execution of foreign judgments on intellectual property rights

Nowadays, intellectual properties with a unique trade value, considered as the motion of international economy. Increasing transnational transactions on intellectual property rights raised so many judicial litigations in this field which in some cases require judicial decisions to be executed within the territory of a state other than the place of the deciding court, this relies on recognizing and enforcing order in foreign country(the place of implementation).Special characteristics of these properties require some particular rules and regulations on recognition and execution of foreign judicial decisions and judgments, this is why that some international model documents have made uniform model regulations which appropriate to characteristics of international intellectual property law, such as CLIP principles and ALI principles. These provide effective international protection of intellectual properties by special developing and facilitating rules on recognition and execution of foreign decisions. However, this issue, in some countries such as Iran, faces with some challenges and required to be discussed and finding possible and proper solutions. Reform and balance municipal laws by referring to the international model documents and conventions, with regard to protection politics and considering national public interests is a well basic principal solution.
